Upon review of the application submitted by the Applicant and the building department file of the above - referenced property, it was determined by the Zoning Administrator that pursuant to Nantucket Zoning Bylaw Section 139- 33.A.(3)(a), the proposed alterations to the structure do not increase the nonconforming nature of said structure. 2. The Applicant is proposing to alter and extend the preexisting nonconforming structure by extending the existing side yard steps approximately three (3) feet south. Such extension will be no closer to the side yard lot line than the existing structure. The applicant is also adding window wells and a bulkhead that will be outside all setbacks. 3. The structure on the Locus is preexisting nonconforming with respect to side yard setbacks, being sited as close as zero (0) feet from the side yard lot line in a zoning district that requires a ten (10) foot side yard setback for properties abutting two or more streets in the Residential - 1 zoning district. 4. Therefore, because the proposed extension will be no closer to the lot line than the existing structure and because there is a privet buffer between Barnabas Lane and the proposed addition as shown on the plan entitled, "Troxell - Nantucket, MA," prepared by Chip Webster Architecture, attached hereto as "Exhibit A ", the proposed work will not increase the nonconforming nature of the structure on the Locus.
