An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town
Clerk, pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the application submitted by the
Applicant and the building department file of the
above- referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3)(a), the proposed
alterations to the structure do not increase the
nonconforming nature of said structure.
The Applicant is proposing to alter the existing
structure by adding a utility shed /mechanical room to
the northeasterly side of the structure. Said utility
shed /mechanical room will be outside all setbacks.
The structure on the Locus is preexisting
nonconforming with respect to rear yard setbacks being
sited as close as 1.3 feet from the rear yard setback
in a zoning district that requires a five (5) foot
side and rear yard setback.
Therefore, because the proposed utility
shed /mechanical room will be no closer to the rear
yard lot line than the existing structure and will be
outside all setbacks as shown on the site plan
entitled, "Mary and Robert Haft, ZBA Application Plot
Plan," as modified by Isaiah Stover, attached hereto
as "Exhibit A ", the proposed work will not increase
the nonconforming nature of the structure on the
Locus.
