Enclosed is the Decision of the Zoning Administrator which has
this day been filed with the office of the Nantucket Town Clerk.
An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town
Clerk, pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the application submitted by the
Applicant and the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3)(a), the proposed
reconstruction of the structure will not increase the
nonconforming nature of said structure.
The Applicant is proposing to reconstruct the addition
to the westerly side of the structure in approximately
the same location as the original structure.
The structure is preexisting nonconforming as to the
westerly side yard and southerly rear yard setbacks,
being sited approximately 3.73 feet from the westerly
side yard lot line and approximately 0.90 feet from
the southerly rear yard lot line in a zoning district
that requires a five (5) foot side and rear yard
setback. The lot is also undersized for the
Residential Old Historic zoning district, having a lot
size of approximately 3,022 square feet where 5,000
square feet is required. The structure has previously
been granted Special Permit relief for a ground cover
ratio of 40.5 %, but no change in ground cover ratio is
proposed as a result of this reconstruction.
Therefore, because the proposed reconstruction will be
no closer to the westerly and southerly lot lines than
the existing structure as shown on the plan entitled,
"Down the Middle Realty Trust, 29 Liberty Street,
Nantucket, MA 02554," prepared by Milton Rowland &
Associates, dated November 14, 2012, attached hereto
as "Exhibit A ", the proposed reconstruction will not
increase the nonconforming nature of the structure on
the Locus.
