Enclosed is the Decision of the Zoning Administrator which has
this day been filed with the office of the Nantucket Town Clerk.
An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town
Clerk, pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the application submitted by the
Applicant and the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3)(a), the proposed
alterations to the structure did not increase the
nonconforming nature of said structure.
2. The Applicant has added additions to the side and rear
of the existing structure. Neither of said additions
is within the setbacks of the Residential - 1 zoning
district. The structure has a ground cover ratio of
approximately 20.4% in a zoning district that allows
for a maximum ground cover ratio of 30 %.
3. The structure on the Locus is preexisting
nonconforming with respect to side yard setback, being
sited as close as 7.2 feet from the side yard lot line
in a zoning district that requires a ten (10) foot
side yard setback for any property abutting two ways
in the Residential - 1 zoning district.
4. Therefore, because the alterations are outside all
setback areas and the ground cover ratio has not been
exceeded as shown on the site plan entitled, "AS Built
Plot Plan, #20 Sherburne Turnpike, in Nantucket,
Massachusetts," dated October 24, 2012, prepared by
Earle 5 Sullivan, Inc., attached hereto as "Exhibit
A ", the work has not increased the nonconforming
nature of the structure on the Locus.
