State below or attach a separate addendum of specific special permits or variance relief applying for:
Applicant leases a portion of the premises, currently known as "The Hub", located at 31 Main
Street, Nantucket, Massachusetts, consisting of approximately 775 square feet of first floor retail
space, and 779 square feet of basement storage space connected with the retail use, hereinafter
"Locus". The retail and commercial storage use at Locus has been in existence since a time well
before July 1972, and has been used continuously since that time. As such, the use is
grandfathered. Even if the use were not grandfathered, pursuant to Section 139-7A of the
Nantucket Zoning Bylaw, the Commercial Downtown (CDT) district allows for retail as a matter
of right.
Further, as there is no parking available at the premises, a waiver of parking spaces has also
been effectively grandfathered, calculated as follows:

Retail 1 per 200 sf of GFA 775/200 4 parking spaces
Storage 1 per 900 sf of GFA 779/900 1 parking space
Employees 1 per 3 employees
during peak shift 4/3 1 parking space

Applicant proposes to convert a portion of the Locus to a coffee bar, similar to the one that was at Locus
in the 1950's and 1960's, selling items including but not limited to coffee, tea, soda, ice cream, and other
prepared foods, etc. Such use is classified as a take-out food establishment and is allowed as a matter of
right in CDT,per Section 139-7A of the Nantucket Zoning Bylaw. The addition of the take-out food
establishment use changes the parking calculation as follows:

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals on Thursday, November 8, 2012 at 1:00 PM at 4
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of THE VALENTINE HUSSEY
BLOCK, LLC AS OWNER; NANTUCKET ISLAND, INC., D /B /A "THE HUB" AS
APPLICANT, c/o Glidden and Glidden, PC, 37 Centre Street,
Nantucket, MA 02554, File No. 069 -12:
2. Applicant is requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Section 139- 18.B(2) (parking waivers)
in order to waive five (5) spaces which are required because the
Applicant is proposing to convert a portion of the Locus for
take -out food. The Applicant has six (6) grandfathered parking
spaces and eleven (11) will be required due to the proposed
take -out food use. The Locus is situated at 31 Main Street, is
shown on Nantucket Tax Assessor's Map 42.3.1 as Parcel 212, and
evidence of owner's title is recorded at the Nantucket County
Registry of Deeds in Book 1067, Page 75. The site is zoned
Commercial Downtown.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation on the basis that no matters of planning concern
were presented. There were no letters on file in support of, or
in opposition to, the project.
4. Attorney Jessie Glidden represented the Applicant at
the hearing. At the hearing, Attorney Glidden explained to the
Board that the Applicant is requesting Special Permit relief
pursuant to Nantucket Zoning Bylaw Section 139- 18.B.(2) in order
to waive five (5) parking spaces. The Applicant presently
leases a portion of the premises known as "The Hub ", located at
31 Main Street. The portion of the premises the Applicant
leases consists of approximately 775 square feet of first floor
retail space and 779 square feet of basement storage space
connected with the retail use. The retail and commercial
storage use on the Locus has been in existence since before 1972
and has been used continuously since that time.

The Applicant now proposes to convert a portion of the Locus to
a coffee bar /soda fountain, similar to the one that was at Locus
in the 1950's and 1960'x, selling items including but not
limited to coffee, tea, soda, ice cream, sandwiches, soups,
various baked goods, and the like. Such use is classified as
a take -out food establishment and is allowed as a matter of
right in CDT, pursuant to Section 139 -7A of the Nantucket Zoning
Bylaw. The addition of the take -out food establishment use with
no seating provided changes the parking calculation as follows:

Accordingly, as eleven (11) parking spaces are now required and
six (6) are grandfathered, the Applicant is requesting a parking

waiver of five (5) spaces pursuant to Nantucket Zoning Bylaw
Section 139- 18.B.(2).
5. The Board and the Applicant discussed the
impossibility of providing off - street parking on Main Street and
the Board agreed that such a waiver request would be in harmony
with the general purposes and intent of the Bylaw and would be
physically impossible to provide given the location of the
Locus.
6. Accordingly, by a UNANIMOUS vote of the sitting Board,
the Board of Appeals found that six (6) parking spaces have been
effectively grandfathered and found Special Permit relief for a
waiver of five (5) parking spaces is in harmony with the purpose
and intent of the Zoning Bylaw and granted the relief requested.
