Enclosed is the Decision of the Zoning Administrator which has
this day been filed with the office of the Nantucket Town Clerk.
An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139-29.C. (3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town
Clerk, pursuant to Nantucket Zoning Bylaw Section 139-29 .C. (6)

DECISION:
1 . Upon review of the application submitted by the
Applicant and the building department file of the
above-referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139-33 .A. (3) (a) , the proposed
alterations to the structure will not increase the
nonconforming nature of said structure.
2 . The Applicant is proposing to add approximately 33 . 3
square feet of living space beneath the second story
over-hang on the southeast corner of the structure.
Said addition will be in the side yard setback, but
will be no closer to the lot line than the existing
structure and will not count towards ground cover.
The Applicant also proposes to add dormers to the
westerly side of the structure that will be outside
the setbacks and will not increase the overall height
of the structure.
3 . The structure on the Locus is preexisting
nonconforming with respect to side yard setback, being
sited as close as 0 . 4 +/- feet from the easterly side
yard lot line in a zoning district that requires a
five (5) foot side yard setback. The structure is
also preexisting nonconforming as to height, being
34 . 2 feet high where thirty (30) feet is the maximum
height allowed.
4 . Therefore, because the proposed alterations will be no
closer to the easterly side yard lot line than the
existing structure as shown on the site plan entitled,
'Mortgage' Plot Plan, Nantucket, MA, " dated October
20, 2012, prepared by On-Island Survey, Co. , attached
hereto as "Exhibit A", the work proposed will not
increase the nonconforming nature of the structure on
the Locus .
