An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town
Clerk, pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(6)

1. Upon review of the application submitted by the
Applicant and the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3)(a), the proposed
alterations to the structure will not increase the
nonconforming nature of said structure.
2. The Applicant is proposing to add a porch and expand
the deck on the southwesterly side of the house. Said
expansion will be outside all setbacks and will be no
closer to the rear or front yard lot lines than the
existing structure.
3. The structure on the Locus is preexisting
nonconforming with respect to front and rear yard
setback, being sited as close as 27.1 +/- feet from
the front yard lot line in a zoning district that
requires a thirty (30) foot front yard setback and
14.3 +/- feet from the rear yard lot line in a zoning
district that requires a fifteen (15) foot side and
rear yard setback. The Locus was rendered preexisting
nonconforming when the property was rezoned to the
Village Residential zoning district in 2009.
4. Therefore, because the proposed alterations will not
be any closer to the rear or front yard lot lines than
existing structure as shown on the site plan entitled,
"Site Plan to Accompany an RDA Application in
Nantucket, MA," dated August 30, 2012, prepared by
Bracken Engineering, Inc., attached hereto as "Exhibit
A ", the work proposed will not increase the
nonconforming nature of the structure on the Locus.
