1. Upon review of the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3)(a), the proposed alteration
and expansion of the preexisting nonconforming
structure will not increase the nonconforming nature
of said structure.
2. The Applicant is proposing to renovate the existing
structure by adding an outdoor shower, a shed dormer,
a 77.54 +/- square foot deck, and a 91.06 +/-
unenclosed covered porch. Said outdoor shower will be
sited in the rear yard setback area (approximately 1.8
feet from the rear yard lot line), but will be no
closer to the rear yard lot line than the existing
structure, which is sited approximately 1.6 feet from
the rear yard lot line. The proposed shed dormer,
deck, and covered porch will be entirely outside the
setbacks.
3. The Locus is nonconforming as to lot size, having a
lot area of about 2,369 square feet in a zoning
district that requires a minimum lot size of 5,000
square feet; nonconforming as to side and rear yard
setbacks, being sited as close as approximately 0.2
feet from the side yard lot line and 1.6 feet from the
rear yard lot line in a zoning district that requires
a side and rear yard setback of five (5) feet;
nonconforming as to frontage, having approximately
38.76 feet of frontage in a zoning district that
requires 50 feet of frontage; and nonconforming as to
ground cover ratio, having a ground cover ratio of
about 42.3% where 30% is allowed by right.

4. Therefore, because the proposed additions, which do
not count towards ground cover, will be no closer to
the setbacks than the existing structure, it was
determined that such an expansion as shown on the site
plan entitled, "Zoning Board of Appeals Plan,"
prepared by Charles W. Hart and Associates, Inc.,
dated October 5, 2012, attached hereto as "Exhibit A ",
will not increase the nonconforming nature of the
structure.
