this day been filed with the office of the Nantucket Town Clerk.
An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town
Clerk, pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(6)

1. Upon review of the application submitted by the
Applicant and the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3)(a), the proposed
alterations to the structure will not increase the
nonconforming nature of said structure.
2. The Applicant is proposing to renovate and alter the
existing structure in accordance with Historic
District Commission Certificate of Appropriateness No.
58,451. There are no proposed changes to ground cover
and no increase in any nonconformity to the structure.
3. The structure on the Locus is nonconforming with
respect to side yard setback, being sited as close as
3.5 +/- feet from the side yard lot line in a zoning
district that requires a five (5) foot side yard
setback. The structure is also nonconforming as to
height, having a ridge elevation of approximately 33.5
feet above mean grade where thirty (30) feet is the
maximum height allowed.
4. Therefore, because the proposed alterations will not
increase height of the structure and will be no closer
to the side yard lot line than existing structure as
shown on the plan entitled, "As -Built Mortgage Plot
Plan in Nantucket, MA," dated July 9, 2012, prepared
by On Island Survey Co., attached hereto as "Exhibit
A ", the work proposed will not increase the
nonconforming nature of the structure on the Locus.
