Upon review of the application submitted by the Applicant and the building department file of the above-referenced property, it was determined by the Zoning Administrator that pursuant to Nantucket Zoning Bylaw Section 139-33 .A. (3) (a) , the proposed alterations to the structure will not increase the nonconforming nature of said structure . 2 . The Applicant is proposing to renovate the existing structures by joining them with a new two-story staircase; by including new dormers and a lower overall roof-line on the existing secondary dwelling; and by constructing an addition outside all setbacks . The Applicant also proposes to construct a new crawl space beneath a portion of the structures and to rebuild some existing walls sited in the setback. Part of the proposed work shall occur in the westerly rear yard setback, but will be no closer to the rear yard lot line than the existing structure. 3 . The dwelling on the Locus is preexisting nonconforming with respect to rear yard setback, being sited as close as 1 . 0 feet from the rear yard lot line in a zoning district that requires a five (5) foot side and rear yard setback. 4 . Therefore, because the proposed alterations will not be any closer to the rear yard lot line than the existing structure as shown on the plan entitled, "Conservation Commission Site Plan in Nantucket, MA, " prepared by Bracken Engineering, dated September 5, 2012, attached hereto as "Exhibit A", the work proposed will not increase the nonconforming nature of the structure on the Locus .
