The dwelling has about 1,212 + 11- SF of ground cover, for a ground cover ratio of about 37.8% where 50% is allowed. At its closest points to the lot lines, the dwelling is sited as close as 22.5 +/- feet from the western side lot line, as close as 5.6 +/- feet from the eastern side lot line, as close as 4.5 +/- feet from the southern side lot line, and as close as 0.9 +/- feet from the northern side lot line, where the minimum side yard setback is 5 feet. The nonconformities pre -exist the 1972 adoption of the Nantucket Zoning By -law. The locus and structures thereon are conforming in all other respects. Applicants propose to alter and expand the dwelling by adding a 1.5 story addition of 265 + /- SF, consistent with the current height of the structure, and also a single story addition of 104 + / -, as per the attached plans, with a proposed new ground cover of 49.3 %, where 50% is allowed. Other exterior work proposed includes removal of the western deck, removal of the skylights, removing a door on the south east corner, and possible changes to the northern dormer (which is in the side setback), pending HDC approval. Accordingly, Applicant request relief by Special Permit under- Nantucket Zoning Bylaw Sections 139- 33.A(4) and 33.E(2)(a) for the alteration of a pre - existing nonconforming structure and expansion of ground cover that is not substantially more detrimental to the neighborhood than the existing nonconformities. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, September 13, 2012, at 1:00 P.M., 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of BARRY A. FISCHMAN, TRUSTEE OF THE SHIRLEE -ANN SCHAFFER QUALIFIED PERSONAL RESIDENCE TRUST #1, c/o Reade, Gullicksen, Hanley and Gifford, LLLP, 6 Youngs Way, Post Office Box 2669, Nantucket, Massachusetts 02554, File No. 055 -12: 2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Sections 139- 33.A.(4) (alteration of preexisting nonconforming structures) and 139- 33.E.(2)(a) (ground cover ratio) in order to alter the preexisting nonconforming structure such that the alterations will not increase the nonconforming nature of the structure and the ground cover ratio will be increased to 49.3% where a 50% ground cover ratio is allowed by Special Permit. The Applicant proposes to alter and expand the preexisting nonconforming dwelling by adding a 1.5 story addition that will be consistent with the current height of the structure and by adding a single story addition to the structure. Applicant also proposed other cosmetic changes to the existing structure that would not increase the ground cover or setback encroachments, such as but not limited to the removal of the western deck, removal of the skylights, removing a door on the south east corner, and possible changes to the northern dormer (which is in the side setback), all pending approval by the Historic District Commission. The structure is nonconforming as to side yard setback, being sited as close as 4.5 feet from the southerly side yard setback and 0.9 feet from the northerly side yard setback in a zoning district that requires a five (5) foot side yard setback. The Locus is also undersized for the Residential 1 Old Historic zoning district, having about 3,205 square feet in a zoning district that requires a minimum lot size of 5,000 square feet. The structure is also nonconforming to ground cover ratio for undersized lots, having a ground cover ratio of 37.8% where a maximum ground cover ratio of 30% is allowed for lots with less than 5,000 square feet. The proposed alterations will be no closer to the setbacks than the existing structure. The Locus is situated at 84 Center Street, is shown on Nantucket Tax Assessor's Map 42.4.3 as Parcel 15.1, is shown in Plan Book 21, Page 48, and is recorded at the Nantucket County Registry of Deeds in Book 372, Page 9. The property is zoned Residential Old Historic. 3. Our decision is based upon the application and accompanying materials, representations, and testimony received at our public hearing. There was no Planning Board recommendation on the basis that no matters of planning concern were presented. There was one letter in favor of the application on file. 4. Attorney Steven Cohen represented the Applicant at the hearing. Attorney Cohen explained to the Board that the Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Sections 139- 33.A.(4) (alteration of preexisting nonconforming structures) and 139- 33.E.(2)(a) (ground cover ratio) in order to alter the preexisting nonconforming structure such that the alterations will not increase the nonconforming nature of the structure and the ground cover ratio will be increased to 49.3% where a 50% ground cover ratio is allowed by Special Permit. Attorney Cohen explained to the Board that the Applicant proposes to alter and expand the preexisting nonconforming dwelling by adding a 1.5 story addition of 265 +/- square feet K that will be consistent structure. Therefore, after a discussion with the agent for the Applicant, the Board finds that such a Special Permit for relief sought by the Applicant pursuant to Nantucket Zoning Bylaw Sections 139- 33.A.(4) and 139- 33.E.(2) in order to alter the structure and add ground cover, as proposed, would not be substantially more detrimental to the neighborhood because said additions and alterations will be no closer to the southerly or northerly side yard lot lines than the existing structure and would be in harmony with the general purpose and intent of the Zoning Bylaw. 6. Accordingly, by a UNANIMOUS vote of the sitting Board, the Board of Appeals grants a Special Permit for the relief sought by the Applicant pursuant to Nantucket Zoning Bylaw Sections 139- 33.A.(4) and 139- 33.E.(2) in order to alter and extend the preexisting nonconforming single- family dwelling without increasing the nonconforming nature of the structurewith the following conditions: a. That the structure shall not get any closer to the lot lines, b. That there shall be no exterior construction for the proposed work, including the exterior use of power tools for interior work or for hardscaping, between Memorial Day and Labor Day of any year.
