Addendum
(Brian Rice and Robert Goldrich, 41 Crooked Lane,
Nantucket, Massachusetts)
The Applicant seeks a special permit under Nantucket Zoning
By -law (the "By- law ") § §139- 33.A.(5) to alter and extend the
preexisting two - story, wood frame dwelling on the locus, which
is nonconforming as to front yard setback, by constructing an
addition to such structure that is within the front yard setback
but that does make the nonconforming distance more
nonconforming. Such structure is located within the required
thirty -five foot front yard setback, but it, the other
structures on the locus, and the locus itself otherwise conform
to all dimensional requirements of the By -law.
The locus is located at 41 Crooked Lane, is shown on
Nantucket Tax Assessor's Map 41 as Parcel 202, is shown as Lot 2
on Land Court Plan 32312 -B and on Land Court Plan 32313 -C, and
is located in the Residential - Twenty zoning district.

1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, September 13, 2012, at 1:00 P.M., 4
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of BRIAN RICE AND ROBERT
GOLDRICH, c/o Sarah F. Alger, P.C., Two South Water Street,
Nantucket, Massachusetts 02554, File No. 054 -12:
2. Applicants are requesting Special Permit relief
pursuant to Nantucket Zoning Bylaw Section 139- 33.A.(5)
(alteration of preexisting nonconforming structure) in order to
alter and extend the preexisting structure on the Locus. Said
structure is nonconforming as to front yard setback, being sited
as close as 3.6 feet from the front yard lot line in a zoning
district that requires a thirty (30) foot front yard setback.
Said alteration will be located in the front yard setback, but
will not be any closer to the front yard lot line than the
existing structure. The Locus is situated at 41 Crooked Lane,
is shown on Nantucket Tax Assessor's Map 41 as Parcel 202, is
shown on Land Court Plan 32312 -B as Lot 2 and Land Court Plan
32313 -C as Lot 6, and title is registered as Certificate of
Title No. 20,897 in the Nantucket County District of the Land
Court. The property is zoned Residential - 20.
3. Our decision is based upon the application and
accompanying materials, representations, and testimony received
at our public hearing. There was no Planning Board
recommendation on the basis that no matters of planning concern
were presented. There was no abutter comment either in favor of
or in opposition to the requested relief.
4. Attorney Sarah F. Alger represented the Applicant at
the hearing. Attorney Alger explained to the Board that the
Applicants are requesting Special Permit relief pursuant to

Nantucket Zoning Bylaw Section 139- 33.A.(5) (alteration and
extension of a preexisting nonconforming structure) in order to
alter and extend the preexisting nonconforming structure on the
Locus without increasing the nonconforming nature of the
structure.
Attorney Alger further explained that said structure is
nonconforming as to front yard setback, being sited as close as
3.6 feet from the front yard lot line in a zoning district that
requires a thirty (30) foot front yard setback. Although the
proposed addition will be located in the front yard setback, it
will not be any closer to the front yard lot line than the
existing structure. Wetlands on the Premises prevent the
construction of an addition in a conforming location on the
property.
S. Therefore, after a discussion with the attorney for
the Applicant, the Board finds that such Special Permit relief
pursuant to Nantucket Zoning Bylaw Section 139- 33.A.(5) in order
to alter and extend the structure such that the proposed
addition will be no closer than 15.78 feet from the front yard
lot line would not be substantially more detrimental to the
neighborhood because said alteration will be no closer to the
front yard lot line than the existing structure. Further,
noting the significant wetlands on the property, the Board of
Appeals finds that this type of alteration would be in harmony
with the general purpose and intent of the Zoning Bylaw.
6. Accordingly, by a UNANIMOUS vote of the sitting Board,
the Board of Appeals made the finding that such Special Permit
relief pursuant to Nantucket Zoning Bylaw Sections 139- 33.A.(5)
in order to alter and extend the preexisting nonconforming
single- family dwelling without increasing the nonconforming
nature of the structure would not be any more detrimental to the
neighborhood than the existing nonconformity and would be in
harmony with the general purpose and intent of the Zoning Bylaw
with the following condition:
a. That all work shall be done as shown on the plan labeled,
"Proposed Conditions Site Plan to Accompany Zoning Board
of Appeals Application in Nantucket, MA." dated August
14, 2012, prepared by Blackwell & Associates, Inc.,
attached hereto as "Exhibit A ".
