At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, September 13, 2012, at 1:00 P.M., 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of TIMOTHY AND MOIRA PARSONS, 80 Old South Road, Nantucket, Massachusetts 02554, File No. 050 -12: 2. Applicants are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139 -7a (uses by special permit) for light manufacturing for the commercial use on the Locus. Said use is allowed by Special Permit in the Residential Commercial - 2 zoning district. The Locus is situated at 80 Old South Road, is shown on Nantucket Tax Assessor's Map 68 as Parcel 411, is shown on Land Court Plan No. 16514 -23 as Lot 511, and title is registered as Certificate of Title No. 19,757 in the Nantucket County District of the Land Court. Mr. Parsons explained to the Board that he is requesting Special Permit relief for light manufacturing for the commercial use on the Locus. Specifically, Mr. Parsons is requesting to continue the operation of his basket shop out of the basement of his residence. Mr. Parsons had previously been allowed to operate his shop under the Home Occupation Use bylaw, but after additions and renovations were made to the structure, the amount 1 of gross floor area used in connection with the home occupation exceeded the allowed 800 square feet. Accordingly, Mr. Parsons is requesting Special Permit relief for light manufacturing in order to continue operating his basket shop. Light manufacturing is allowed by Special Permit in the Residential Commercial - 2 zoning district. 5. Therefore, after a discussion with the Applicants, the Board finds that such Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139 -7.A for light manufacturing would in harmony with the general purpose and intent of the Zoning Bylaw because of the ample parking provided on the Locus (Five parking spots are required and five spots are provided), the screening, and the light commercial nature of the business in the Residential Commercial - 2 zoning district. 6. Accordingly, by a UNANIMOUS vote of the sitting Board, the Board of Appeals made the finding that such Special Permit relief pursuant to Nantucket Zoning Bylaw Sections 139 -7.A for light manufacturing would be in harmony with the general purpose and intent of the Zoning Bylaw with the following condition: a. That parking area and screening shall conform to the site plan labeled, "Site Plan of Land in Nantucket, Mass.," dated September 27, 2012, prepared by Island Surveyors, LLC, attached hereto as "Exhibit A."
