Upon review of the application submitted by the Applicant and the building department file of the above - referenced property, it was determined by the Zoning Administrator that pursuant to Nantucket Zoning Bylaw Section 139- 33.A.(3)(a), the proposed alterations to the structure will not increase the nonconforming nature of said structure. 2. The Applicant is proposing to construct a second floor over the existing one story sited outside the setbacks; expand the existing covered porch sited outside the setbacks; and to change the windows and doors on the structure. All of said exterior construction will be located in the buildable area of the Locus and outside all setbacks. 3. The structure on the Locus is preexisting nonconforming with respect to front yard setback, being sited as close as twenty -eight (28) feet from the front yard setback in a zoning district that requires a thirty (30) foot front yard setback. When the structure was constructed in 1974, the front yard setback in the Residential - 2 zoning district in which the locus was situated was twenty (20) feet. In 1984, the front yard setback requirements of the Residential - 2 zoning district changed from twenty (20) feet to thirty (30) feet. Therefore, because the front yard setback requirements changed after the structure was sited, the structure has preexisting nonconforming status. 4. Therefore, because the proposed alterations will not be any closer to the front yard setback than the existing structure as shown on the plan entitled, "Halle Lamm Res.," prepared by Milton Rowland & Associates, attached hereto as "Exhibit A ", the work IN proposed will not increase the nonconforming nature of the structure on the Locus.
