II. Approval of the Agenda: A motion was made (Botticelli) and duly seconded to approve the agenda as written. The vote was 5 -0 in favor. III. Approval of the Minutes: A motion was made (O'Mara) and duly seconded to approve the minutes of May 10, 2012. The vote was 5 -0 in favor. IV. Attorney Andrew Singer represented the Applicant at the hearing. Attorney Singer discussed the materials he had submitted prior to the hearing and addressed some of the discrepancies in his waiver request. Kerim Koseatac asked the Applicant to provide more lighting on the sidewalks. The Board decided that there should be at least four street lamps in the development, spread out appropriately. The Board and the Applicant also discussed the possibility of developing the basements. The Board expressed concern with allowing the homeowners to develop the basements and thereby create an additional bedroom. Rob Anderson mentioned that Habitat for Humanity's house model includes a bedroom in the basement. The Board and the Applicant decided that the basements shall only have a bulkhead and the Habitat model shall be exempt. The Board also confirmed with the Applicant that there shall be no attic expansion and no outward expansion of the structures. The Board and the Applicant also discussed revising the language of the Homeowners' Association documents in order to clear up any ambiguity. The Board and the Applicant further discussed the proposed landscaping and the type of trees that will be planted. There was a discussion regarding the possible profit derived from this project. The Applicant informed the Board that they would come back with additional information at the next hearing. A motion was made (Botticelli) and duly seconded to continue the matter to July 121h at noon. Ms. Ewing submitted documents to the Board showing the location of the easement and that the Applicant has the right to access said easement. The Board expressed additional concerns over the amount of parking provided on the Locus. Ronnie Bamber, an abutter, noted that he did not think the parking provided was sufficient to address the amount of traffic expected. The Board suggested reconfiguring the building location in order to incorporate another parking space on the Locus. A motion was made (Koseatac) and duly seconded to continue the matter to the July 12th. The vote was 5 -0 in favor. 029 -12 Seven Farmer, LLC Action Deadline July 11, 2012. 7 Farmer Street Alger Attorney Sarah Alger represented the Applicant. Attorney Alger explained to the Board that the proposed alterations would not increase the nonconforming nature of the structure. A motion was made (Wain) and duly seconded to approve the requested relief. The vote was 5 -0 in favor (Toole, O'Mara, Waine, Koseatac, McCarthy). Attorney Alger explained the nature of the application to the Board and further added that there would be no need for a parking waiver because some of the parking would be located on the adjacent lot. A motion was made ( Angelastro) and duly seconded to approve the requested relief. The vote was 5 -0 in favor (Toole, O'Mara, Koseatac, McCarthy, Angelastro). After explaining the nature of the Variance request and listening to the feedback from the Board, the Applicant requested the matter be withdrawn without prejudice. A motion was made (Botticelli) and duly seconded to allow the matter to be withdrawn without prejudice. Attorney Richard Glidden represented the Applicant. Attorney Glidden explained to the Board that the Applicant is requesting to change the use of the preexisting nonconforming structure, but not make any exterior alterations to the structure. A motion was made (Wain) and duly seconded to grant the relief requested. The vote was 5 -0 in favor (Toole, Waine, O'Mara, Koseatac, Angelastro). Weinman represented the Applicant. Attorney Weinman explained to the Board the proposed change to the hours of operation. One abutter was present and asked the hours be limited to midnight instead of 1:00 am. The Board and the Applicant agreed that this was a fair compromise. A motion was made (O'Mara) and duly seconded to approve the requested relief. The vote was 5 -0 in favor (Toole, O'Mara, Koseatac, Botticelli, McCarthy).
