An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town
Clerk, pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(6)

DECISION:
1. Upon review of the application submitted by the
Applicant and the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(8), the proposed alterations
to the preexisting nonconforming lot will not increase
the nonconforming nature of said lot and will not be
substantially more detrimental to the neighborhood.
2. The Applicant was the successful bidder of "Parcel El
Pocomo Avenue" and "Parcel G1 Irving Street" of the
so- called Town of Nantucket Yard Sale Program. Upon
merger of these parcels with the Applicant's
preexisting nonconforming lot, the Applicant increased
his legal frontage from zero (0) feet to sixty (60)
feet on Pochick Avenue. The Locus is situated in a
zoning district that requires a minimum frontage of
100 feet.
3. Therefore, because the proposed alteration to the lot
as shown on the plan entitled, "Proposed Site Plan in
Nantucket, MA," prepared by Bracken Engineering, Inc.,
dated June 25, 2012, attached hereto as "Exhibit A ",
will increase the legal frontage from zero (0) feet to
sixty (60) feet in a zoning district where 100 feet of
frontage is required, said alterations will not
increase the nonconforming nature of said lot and will
not be substantially more detrimental to the
neighborhood.
