An Appeal from this Decision to the Zoning Board of Appeals may be
taken pursuant to Nantucket Zoning Bylaw Section 139- 29.C.(3)
Any action appealing the Decision must be brought by filing a
notice of appeal, specifying the grounds thereof, with the Town

1. Upon review of the application submitted by the
Applicant and the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3)(a), the proposed
alterations to the structure will not increase the
nonconforming nature of said structure.
2. The Applicant is proposing interior renovations,
removal of a covered patio, creation of a new stoop,
and construction of a new third floor dormer to the
existing structure. All of said exterior construction
will be located in the buildable area of the Locus and
outside all setbacks. As a result of the renovations,
the ground cover on the Locus will still be conforming
to the Residential Old Historic zoning district
intensity regulations for ground cover.
3. The structure on the Locus is nonconforming with
respect to front yard setback, encroaching into the
roadway layout of Pine Street. The structure on the
Locus is also nonconforming as to side yard setback,
being sited as close zero (0) feet from the side yard
setback in a zoning district that requires a five (5)
foot side yard setback.
4. Therefore, because the proposed alterations will be no
closer to the setbacks than the existing structure as
shown on the plan entitled, "DuPont Residence,"
prepared by Milton Rowland & Associates, attached
hereto as "Exhibit A ", the work proposed will not
increase the nonconforming nature of the structure on
the Locus.

screened -in porch, a new second floor dormer that will
not be higher than the existing ridgeline of the
structure, and extending the third floor dormer
approximately 4.33 feet. All of said exterior
construction will be located in the buildable area of
the Locus and outside all setbacks. As a result of
the renovations, the ground cover on the Locus will
still be conforming to the Residential Old Historic
zoning district intensity regulations for ground cover
and the height of the structure will not have
increased.
3. The structure on the Locus is nonconforming with
respect to front yard setback, encroaching into the
roadway layout of Pine Street. The structure on the
Locus is also nonconforming as to side yard setback,
being sited as close zero (0) feet from the side yard
setback in a zoning district that requires a five (5)
foot side yard setback. Also, the structure exceeds
thirty (30) feet as an average mean height above
grade.
4. Therefore, because the proposed alterations will be no
closer to the setbacks than the existing structure and
the height of the structure will not increase as shown
on the plan entitled, "DuPont Residence," prepared by
Milton Rowland & Associates, attached hereto as

nonconforming nature of the structure on the Locus.
