Special permits or variance relief applying for:
The pre- existing, nonconforming two -story structure is a single family dwelling
on a lot of about 8,880 SF in the Residential Old Historic zoning district, where 5,000
SF is the minimum required. The dwelling has about 1,459 SF of ground cover and
an ancillary garage has about 261 SF of ground cover, for a total ground cover ratio
of about 19.4% where 50% is allowed. The dwelling is sited as close as 0.4 feet from
the eastern/side lot line at its closest point where the minimum side yard setback is 5
feet. Further, the garage is located within a peninsula at the rear of the lot and is sited
as close as 2.3 feet from the eastern/side lot line, as close as 1.1 feet southerly /rear lot
line, and as close as 1.1 feet from the western/side lot line at its closest points, all
within the 5 foot setbacks. These nonconformities pre -exist the 1972 adoption of the
Nantucket Zoning By -law. The locus and structures thereon are conforming in all
other respects.
Applicants propose to alter and expand the dwelling including the portion
currently within the side setback by adding about 360 SF of ground cover (inclusive
of the 315 SF previously approved by the Board) and other changes, as per the
attached plans, including a second story expansion over a portion of the encroaching
structure. The new ground cover ratio will be 20 %. The proposed alterations and
expansion would not be closer to the easterly side lot line than the existing structure.
Accordingly, Applicants request relief by Special Permit under Nantucket Zoning
Bylaw Section 139 -33.A (4) and (5) for the alteration of a pre- existing
nonconforming structure where the change is not substantially more detrimental to
the neighborhood than the existing nonconformities.

1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, August 11, 2011, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of DENNIS CROSS and ANNE
CROSS, as Trustees of THIRTY -FOUR INDIA STREET TRUST, c/o Reade,
Gullicksen, Hanley, and Gifford, LLP, 6 Young's Way, Post Office
Box 2669, Nantucket, MA 02584, File No. 047 -11:
2. Applicants are requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Section 139- 33.A.(4) and (5)
(alteration of preexisting nonconforming structures) to alter the
preexisting, nonconforming dwelling. The existing dwelling is
sited as close as 0.4 from the easterly side yard lot line in a
zoning district that requires a five foot side yard setback. The
proposed alterations will not be closer to the easterly side lot
line than the existing structure. The Locus is situated at 34
India Street, is shown on Nantucket Tax Assessor's Map 42.3.4 as
Parcel 151, is shown in Plan Book 9, Page 39, and title is
recorded at the Nantucket County Registry of Deeds in Book 1016,
Page 233. The property is zoned Residential Old Historic.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. No abutter comment was received either in favor
or in opposition to the application.
4. Attorney Steven Cohen represented the Applicant.
Attorney Cohen explained to the Board that the Applicants are

requesting Special Permit relief pursuant to Nantucket Zoning
Bylaw Sections 139- 33.A.(4) and (5) (alteration of preexisting
nonconforming structures) in order to alter the preexisting
nonconforming dwelling. The dwelling is sited as close as 0.4
feet from the easterly side yard lot line in a zoning district
that requires a five foot side and rear yard setback. Further,
the garage is sited as close as 2.3 feet from the easterly side
yard lot line, 1.1 feet from the southerly rear yard lot line,
and as close as 1.1 feet from the westerly side yard lot line.
The Locus is otherwise conforming to the intensity regulations of
the Residential Old Historic zoning district.

5. Therefore, after a discussion with Counsel for the
Applicant, the Board finds that such a Special Permit may be
granted to approve the alteration of the preexisting
nonconforming structure as the alteration will not intrude any
further into the easterly setback than the existing setback
violation on the Locus. The Board determined that this type of
alteration would not be substantially more detrimental to the
neighborhood than the existing nonconformity on the Locus.
6. Accordingly, by a unanimous vote of the sitting Board,
the Board of Appeals made the finding that the proposed
alteration to the preexisting nonconforming structure would not
be substantially more detrimental to the neighborhood than the
existing nonconformity and allowed the proposed alteration to the
structure with the conditions:
a) That all work shall be done in substantial conformity
with the plan entitled "Building Location Plan in
Nantucket, MA ", prepared by Charles W. Hart and
Associates, Inc., dated July 19, 2011, attached hereto as
"Exhibit A."
