Applicant is contract purchaser of property located at 9 Prospect Street. The property is
an undersized Lot of record, containing 3,911 square feet in a zoning district requiring
5,000 square feet of area and having 42.67 feet of frontage in a zoning district requiring
50 feet of frontage. The property is improved with two structures both built prior to the
enactment of the zoning by -law. There is a dwelling house which has 922.50 ± square
feet of ground cover, and another building which contains a bathroom and one large room
which has 280 ± square feet of ground cover. The total ground cover is 31 % in a zoning
district allowing 30% ground cover. The dwelling house violates the side -line set -back
on the west being 3.94 feet in a zoning district requiring a 5 foot set -back, and the other
structure violates the rear yard set -back, being .03 feet in a zoning district requiring 5
feet, and violates the side -line set -back on the east being 3.40 feet in a zoning district
requiring 5 feet.
Applicant seeks a special permit, pursuant to CH 139 0 33 A (4) allowing them to install
a kitchen in the rear building and convert it to habitable living space. There will be no
change in the ground cover and there will be no second floor added to the building.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, June
14, 2012, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of JAMES SIMONE and MARCELLA SIMONE c/o
Glidden & Glidden, P.C., 37 Center Street, Post Office Box 1079, Nantucket, Massachusetts
02554, File No. 036 -12:
2. The Locus is situated at 9 Prospect Street, is shown on Nantucket Tax Assessor's
Map 55.4.4 as Parcel 41, is shown on Plan Book 22, Page 88, and title is recorded at the
Nantucket County Registry of Deeds in Book 210, Page 32.
3. Applicants are requesting Nantucket Zoning Bylaw Sections 139- 33.A.(4)
(alteration of preexisting nonconforming structures and uses) in order to alter the preexisting
nonconforming rear building by installing a kitchen and converting said building to habitable
space. There will be no change in ground cover and there will be no second floor added to said
structure. The property is nonconforming as to lot size, having approximately 3,911 square feet
in a zoning district that requires a minimum lot size of 5,000 square feet; nonconforming as to
frontage, having 42.67 in a zoning district that requires a minimum of fifty feet of frontage;
nonconforming as to ground cover ratio, having a ground cover ration of approximately 31 % in a
zoning district that allows for a maximum ground cover ratio of 30 %; and nonconforming as to
setbacks, being sited as close as 3.94 feet from the westerly side yard setback in a zoning district
that requires a five (5) foot side and rear yard setback. The Locus is situated at 9 Prospect Street,
is shown on the Nantucket Tax Assessor's Map 55.4.4 as Parcel 41, is shown on Pan Book 22,
Page 88, and is recorded at the Nantucket County Registry of Deeds in Book 210, Page 32. The
site is zoned Residential -1.
4. Attorney Richard J. Glidden presented the case for the applicant. Attorney
Glidden explained that Mr. and Mrs. Simone have contracted to purchase the property at 9
Prospect Street. They plan to convert the back building, which is a pre- existing studio with
bathroom, into habitable living space with a kitchen. There will be no change in the footprint of
the structure and no change in the height of the building nor any increase in the interior foot-
print. Two stacked parking spaces will be provided on the lot. The applicants require special
permit relief because the lot is non - conforming and the existing structure violates the side and
rear yard set - backs. Second dwellings are allowed in this zoning district and there will be no
structural changes other than that a legal kitchen is going to be installed in the existing structure.

5. After discussion among the board members, the board finds that the proposed
addition to the existing studio building by the addition of a kitchen which will make the existing
structure habitable living space, will be in harmony with the spirit and intent of the zoning by-
law and will not be substantially more detrimental to the neighborhood than the existing non-
conformity on the locus.
6. Accordingly, by a unanimous vote of the board, the board grants the requested
special permit pursuant to Nantucket Zoning Bylaw Section 139- 33.A.(4) allowing the
installation of a kitchen and conversion of the rear building to habitable living space, as shown
on the plan entitled, "`As- Built' Plan, Nantucket, MA," prepared by On- Island Survey Co., Inc.,
dated May 7, 2012, attached hereto as "Exhibit A."
