The property is located at 25 and 27 Young's Way, is
shown on Nantucket Tax Assessor's Map 67 as Parcels 68 and
69, is shown on plan recorded with Nantucket Deeds on Plan
No. 2003 -10 as Lots 24 and 23, and is located in the
Residential Commercial 2 ( "RC -2 ") Zoning District (the
"Locus ").
The Applicant owns the property at 25 Young's Way and
has leased the property at 27 Young's Way. The Applicant
seeks a Special Permit under Nantucket Zoning By -law (the
"By -law) §139 -7 to construct a recreational facility,
having 3,600 square feet of gross floor area, on property
at 25 Young's Way. The Applicant also seeks a special
permit under By -law §139- 18.B(1) to allow parking on the
adjacent property at 27 Young's Way. The Applicant
proposes to limit the building occupancy to no more than 51
persons at any one time and to have a maximum of six (6)
employees at peak shift. By -law §139 -18 requires 1 space
for each 3 employees at peak shift and 1 space for each 3
persons of certified building occupancy. The proposed use
requires the provision of 19 spaces that the Applicant
proposes to provide on the Locus. The Applicant also
proposes to provide the required loading zone, to
effectively screen the parking area from the all adjacent
properties, and to otherwise meet all provisions of the By-
law.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, June 14, 2012, at 12:00 P.M., at 4
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of LUCINDA YOUNG, TRUSTEE
OF STURGIS PINES NOMINEE TRUST AS OWNER, and WISENTANER, INC. AS
APPLICANT AND OWNER, both c/o 8 Moors End Lane, Nantucket, MA
02554, File No. 037 -12:
2. Applicant is requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Section 139 -30 (Special Permits) in
order to operate a 3,600 square foot recreational facility
pursuant to Section 139 -7.A (use chart - allowed uses by Special
Permit) on 25 Young's Way. The Applicant also seeks a Special
Permit pursuant to Section 139- 18.B.(1) (parking) to allow
parking on the adjacent property at 27 Young's Way. Said use
is allowed in the Residential Commercial - 2 zoning district by
Special Permit relief. The Locus is situated at 25 and 27
Young's Way, is shown on Nantucket Tax Assessor's Map 67 as
Parcel 688 and 689, is shown as Lots 24 and 23 on Plan 2003 -10,
and is recorded at the Nantucket County Registry of Deeds in
Book 1323, Page 115 and Book 731, Page 167, respectively. The
property is zoned Residential Commercial - 2.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation on the basis that no matters of planning concern
were presented. There were no letters on file in support of, or
in opposition to, the project.

4. Attorney Sarah F. Alger represented the Applicant at
the hearing. At the hearing, Attorney Alger explained to the
Board that the Applicant is requesting Special Permit relief
pursuant to Nantucket Zoning Bylaw Section 139 -30 (Special
Permits) in order to operate a 3,600 square foot recreational
facility pursuant to Section 139 -7.A (use chart - allowed uses
by Special Permit) on 25 Young's Way.
Additionally, the Applicant is requesting Special Permit relief
pursuant to Section 139- 18.B.(1) (parking) to allow parking on
the adjacent property at 27 Young's Way. The Applicant proposes
to limit the building occupancy to no more than 51 persons at
any one time and to have a maximum of six (6) employees at peak
shift.
Section 139 -18.D. of the Bylaw requires 1 space for each 3
employees at peak shift and 1 space for each 3 persons of
certified building occupancy. The proposed use therefore
requires 19 spaces and the Applicant is providing these spaces
on the Loci as shown on the site plan entitled, "Site Plan to
Accompany a Z.B.A. Application," prepared by Blackwell and
Associates, Inc., dated May 14, 2012, attached hereto as
"Exhibit A." The Applicant also proposes to provide the
required loading zone and to screen the parking area from all
adjacent properties.
5. After a discussion between the Board and the
Applicant, the Board found that Special Permit relief for the
recreational facility and for the Applicant to provide parking
on the adjacent lot via lease would be in harmony with the
purpose and intent of the Zoning Bylaw because such a use is
appropriate in the Residential Commercial - 2 zoning district.
6. Accordingly, by a UNANIMOUS vote of the sitting Board
of Appeals, the Board found that Special Permit relief for a
recreational facility on 25 Young's Way and parking for said use
on the adjacent lot as shown on the plan entitled, "Site Plan to
Accompany a Z.B.A. Application," prepared by Blackwell and
Associates, Inc., dated May 14, 2012, attached hereto as
"Exhibit A ", is granted with the following conditions:
a. That there shall be a lease between the Applicant and the
property owner of 27 Young's Way (Map 67, Parcel 689) to
allow thirteen (13) parking spaces to be sited on 27
Young's Way and notice of said lease shall be recorded;

b. That the hours of operation of the recreational facility
shall be from 5:30 A.M. to 8:30 P.M.;
c. That the windows and doors shall be closed while the
building is in use;
d. That should the lease between the Applicant and the owner
of 27 Young's Way terminate, then the Applicant shall
cease the operation of said recreational facility.
