Toole, 44 Liberty Street, Nantucket, Massachusetts) The Applicant seeks a special permit under Nantucket Zoning By -law (the "By- law ") §§139- 33.A.(4) and (9) to alter and extend the single- family dwelling located upon the property that is nonconforming as to side -yard setback, having setback from Brock's Court of only about seven feet (7') where a ten foot (10') setback is required from any street or way under By -law §139 -16 in the Residential One zoning district. The property has its front yard setback from Liberty Street. The Applicant proposes to pick up the dwelling and relocate on the lot in such a way that it conforms to all provisions of the By -law, with the exception of the setback from Brock's Court, which shall not be made more non - conforming. The Applicant also proposes to make additions to the dwelling that will conform to the provisions of the By -law in all ,respects. The property contains 18,675 square feet of lot area where 5,000 square feet is the minimum required. The property has frontage of 59.41 feet on Liberty Street where 50 feet is required. The existing dwelling has ground cover of 6.2% where 30o is permitted. Front Yard setback of ten feet (10') will be maintained from Liberty Street, and side and rear yard set back of five feet (5') will be maintained on the west and the south. Parking for the property will be provided either from Liberty Street or Brock's Court. The Premises are located at 44 Liberty Street in a Residential -One zoning district. The Locus is situated at 44 Liberty Street, is shown on Nantucket Tax Assessor's Map 42.3.4 as Parcel 84, is shown on Plan No. 2007 -44 as Lot 2 and Parcel A, and is recorded at the Nantucket County Registry of Deeds in Book 1318, Page 339. The site is zoned Residential - 1. 1 3. Our decision is based upon the application and accompanying materials, representations, and testimony received at our public hearing. There was no Planning Board recommendation on the basis that no matters of planning concern were presented. There were letters on file asking for additional information from the Applicant. 4. Ray Pohl represented the Applicant at the hearing. Mr. Pohl explained to the Board that the Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Sections 139- 33.A.(4) and (5) (alteration and extension of preexisting nonconforming structures) in order to alter and extend the preexisting nonconforming single- family dwelling on the Locus without increasing the nonconforming nature of said structure. The Applicant is proposing to pick up the dwelling and relocate it on the lot in such a way that it conforms to all provisions of the Bylaw, with the exception of the setback from Brock's Court, which shall not be made more nonconforming. The structure is presently preexisting nonconforming as to side - yard setback, the porch being sited as close as seven (7) feet (about 4.6 feet to the bottom step) from the side yard setback from Brock's Court in a zoning district that requires a ten (10) foot setback from any street or way pursuant to Nantucket Zoning Bylaw Section 139- 16.C.(3). Upon relocation, the structure will be no closer to Brock's Court than it is now and will meet all other setback regulations of the Residential - 1 zoning district. The Applicant also proposes to make additions to the dwelling that will conform to the provisions of the Bylaw in all respects as all alterations will be outside the required setbacks. 5. Therefore, after a discussion with the agent for the Applicant, the Board finds that such Special Permit relief pursuant to Nantucket Zoning Bylaw Sections 139- 33.A.(4) and (5) in order to alter and relocate the structure so that it is no closer to Brock's Court than it currently is would not be substantially more detrimental to the neighborhood because said alterations will be no closer to the setbacks than the existing structure and because the relocation of the structure will be further from the easterly lot line than the existing structure. Further, the Board of Appeals finds that this type of alteration would be in harmony with the general purpose and intent of the Zoning Bylaw. 6. Accordingly, by a UNANIMOUS vote of the sitting Board, the Board of Appeals made the finding that such Special Permit 2 relief pursuant to Nantucket Zoning Bylaw Sections 139- 33.A.(4) and (5) in order to alter and relocate the preexisting nonconforming single- family dwelling without increasing the nonconforming nature of the structure would not be any more detrimental to the neighborhood than the existing nonconformity and would be in harmony with the general purpose and intent of the Zoning Bylaw with the following conditions: a. That all work shall be done so that the structure as so relocated, altered, and extended is no closer to Brock's Court than it currently is as shown on the Mortgage Plot Plan drawn by Joseph E. Marcklinger, attached hereto as "Exhibit A" and meets all other setback regulations of the Residential - 1 zoning district; and b.
