1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, June 14, 2012, at 12:00 P.M., at 4
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of FIVE CHESTNUT STREET,
LLC, c/o Vanessa Noel Ginley, 158 E. 64th Street, New York, New
York 10065, File No. 039 -12:
2. Applicant is requesting a modification to Special
Permit No. 026 -08 in order to extend the hours of operation of
the cafe to 1:00 A.M. The Locus is situated at 5 Chestnut
Street, is shown on Nantucket Tax Assessor's Map 42.3.1 as
Parcel 5, is shown in Plan Book 46, Pages 485 and 525, and is
recorded at the Nantucket County Registry of Deeds in Book 528,
Page 50. The site is zoned Commercial Downtown.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. There were letters in support of the
application on file, as well as a letter of opposition. An
abutter was present at the hearing to speak against the
application.
4. Attorney Rhoda Weinman represented the Applicant.
Attorney Weinman explained that the Applicant is proposing to
increase the hours of operation for the cafe to 1:00 A.M.
Counsel explained to the Board that the Locus has not had any
complaints filed with the Nantucket Police Department and the
cafe is only 27 seats. Counsel further pointed out to the Board
that no other cafes in the Commercial Downtown zoning district
have this restriction in place.
5. An abutter was concerned that having the cafe open to
1:00 A.M. would increase the noise and the traffic along Quince
Street. Counsel for the Applicant, the abutter, and the Board
of Appeals agreed that having a closing time of midnight would
be a fair compromise.
6. Accordingly, by unanimous vote, the Board of Appeals
made a finding that the proposed modification to extend the
hours of operation of the cafe to midnight would be in harmony
with the purpose and intent of the Zoning Bylaw subject to the
following condition:
(a) All other conditions from previously recorded
Zoning Board of Appeals decisions affecting the Locus shall
remain in full force and effect.
