At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, June 14, 2012, at 12:00 P.M., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of PEARL STREET REALTY, LLC AS OWNER; MICHAEL FLEISCHUT AS APPLICANT, c/o Michael Fleischut, 4 India Street, Nantucket, Massachusetts 02554, File No. 040 -12: 2. Applicant is requesting a modification to Special Permit No. 023 -92 to change the allowed hours of operation from 10:00 A.M. - 10:00 P.M. to 7:00 A.M. - 10:00 P.M. The Locus is situated at 4 India Street, is shown on Nantucket Tax Assessor's Map 42.3.1 as Parcel 167, and is recorded at the Nantucket County Registry of Deeds in Book 162, Page 220. The site is zoned Commercial Downtown. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that no matters of planning concern were presented. There was one letter on file requesting the Applicant to open at 8:00 A.M. 4. Michael Fleischut represented himself at the hearing. Mr. Fleischut explained to the Board that business on the Locus, The Nantucket Gourmet, would like to begin serving breakfast. In order to do so, the Applicant needs to modify the existing Special Permit in Decision No. 023 -92 to change the hours of operation from 10:00 A.M. - 10:00 P.M. to 7:00 A.M. - 10:00 P.M. 5. The Board discussed the abutter's letter on file that asked the Applicant to open no earlier than 8:00 A.M. The Board was appreciative of the abutter's concerns, but ultimately found that opening at 7:00 A.M. would be in harmony with the purpose and intent of the Zoning Bylaw. 6. Accordingly, by unanimous vote, the Board of Appeals made a finding that the proposed modification to change the hours of operation from 10:00 A.M. - 10:00 P.M. to 7:00 A.M. - 10:00 P.M. would be in harmony with the purpose and intent of the Zoning Bylaw subject to the following condition: (a) All other conditions from previously recorded Zoning Board of Appeals decisions affecting the Locus shall remain in full force and effect.
