Addendum to Special Permit Application -16 Quince St., Marmelo, LLC
Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Sections 139 -
33.A.(4) and (5) (alteration of preexisting nonconforming structures and uses) in order to alter
and extend the preexisting nonconforming structure on the Locus without increasing the
nonconforming nature of said structure. The Applicant is proposing to construct a two- tiered
porch to the rear of the main structure. Said addition will be entirely outside the setbacks. The
lot is nonconforming as to lot size and frontage, having 2,527 square feet in a zoning district that
requires a minimum lot size of 5,000 square feet and having frontage of only 29.70 feet of
frontage on Quince Street in a zoning district that requires a minimum frontage of 50 feet. The
structures on the Locus are nonconforming as to side and rear yard setbacks, being sited as close
as 4.1 feet from the westerly side yard setback, 0.4 feet from the easterly side yard setback, and
3.42 from the southerly rear yard setback in a zoning district that requires a five (5) foot side and
rear yard setback. The Locus is situated at 16 Quince Street, is shown on Nantucket Tax
Assessor's Map 42.3.4 as Parcel 58, is shown on Plan No. 2011 -31, and is recorded at the
Nantucket County Registry of Deeds in Book 1283, Page 32. The site is zoned Residential Old
Historic.

notice of appeal, specifying the grounds thereof, with the Town

Residential Old Historic
DECISION:
1. Upon review of the building department file of the
above - referenced property, it was determined by the
Zoning Administrator that pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(3)(a), the proposed alteration
and expansion of the structure will not increase the
nonconforming nature of said structure.
2. The Applicant is proposing to construct a new two -
tiered porch and refurbish and existing outdoor
shower. Said porch will be to the rear of the
existing primary dwelling and will comply with all
setback regulations. The refurbished shower will
remain in approximately the same location as it
exists, which is approximately 0.4 feet from the
easterly side yard lot line.
3. The lot is preexisting nonconforming as to the minimum
lot size of the Residential Old Historic zoning
district, having approximately 2,527 square feet in a
zoning district that requires a minimum lot size of
5,000 square feet. The structures thereon are also
preexisting nonconforming to the intensity regulations
of the Residential Old Historic zoning district, being
as close as 4.1 feet, 0.4 feet, and 1.2 feet from the
side and rear yard setbacks, respectively.
4. Therefore, because the expansion of the preexisting
nonconforming structure will be no closer to the side
and rear yard setbacks than what presently exists, it
was determined that such an expansion as shown on the
site plan entitled, `Site Plan, 16 Quince Street,"
prepared by Bracken Engineering, dated April 3, 2012,

attached hereto as "Exhibit A ", will not increase the
nonconforming nature of the structure.
