Plans approved by the Historic District Commission and filed with the Building Department show that a portion of the structure would be more than five feet, but less than ten feet, from the westerly side lot line along Highland Avenue, with the structure maintaining the ten -feet required front yard setback from Cliff Road. These plans, depicting setback lines, included a plan prepared for the applicant by a registered Professional Land Surveyor licensed in Massachusetts, showing the setback as being ten feet from Cliff Road and five feet from all other property lines, including the boundary with Highland Avenue. A building permit was issued after review by the Zoning Enforcement Officer, and construction has proceeded, with the foundation in place and framing having been completed. In fact, in the Residential -1 zoning district in which the locus is situated, on a lot which abuts two or more streets or ways must maintain a minimum setback of ten feet from any street or way, pursuant to Nantucket Zoning By -law §139- 16.C(3). The Zoning Enforcement Officer has now issued a Notice of Zoning Code Violation dated April 5, 2012, informing the applicant that it is in violation of By -law §139 -16.A (sic). The as -built plan obtained by the applicant shows the structure's foundation as being sited 6.50 feet from Highland Avenue at its closest point. Accordingly, the applicant requests relief by Special Permit under By -law §139 - C(2), to validate the siting of the structure as an unintentional setback intrusion not greater than five feet into a required yard and not closer than four feet from a lot line, reasonably based upon a licensed survey. In the alternative, the applicant requests relief by Variance from the provisions of §139- 16.C(3) to validate the siting of the structure.
