Griswold and Margaret S. Griswold 14 Mayhew Lane The applicants, Richard J. Griswold and Margaret S. Griswold (hereinafter the "Applicants "), request a Modification to the Zoning Board of Appeals ( "ZBA ") Special Permit, File No. 014 -12. In the alternative, the Applicants request Special Permit relief pursuant to Sections 139- 33A(4) and 139- 33A(5) of the Nantucket Zoning By -Law for their property located at 14 Mayhew Lane, Nantucket, Massachusetts 02554 (the "Property "), Parcel 447 on Nantucket Town Assessor's Map 41, Lot 1 on Plan File 16 -E at the Nantucket Registry of Deeds. The Property is a 20,301 square foot lot located in the R -20 Zoning District. The Property is shown on a Site Plan of Land In Nantucket, Mass., prepared for Richard J. and Margaret S. Griswold, by Island Surveyors, LLC, dated April 10, 2012 (the "Plan"), a copy of which is attached hereto as Exhibit "A ". As shown on the Plan, there is one single family dwelling on the Property. The dwelling was constructed in 1979. At that time the front yard set- back requirement for the Property was 20 feet. Currently, a small portion (135 + /- square feet as shown on the Plan) of the dwelling is sited as close as 19.8 + /- from the front yard lot line in a Zoning District that requires a front yard set -back of 30 feet. The dwelling has a ground cover of 2,568, exceeding the permitted ground cover ratio of 12.5% , by 31 +/- square feet. The Property conforms in all other respects with zoning requirements. On February 9, 2012, the ZBA granted the previous owner of the Property Variance Relief under Section 139 -32 of the By -Law to validate the ground cover violation on the Property and Special Permit Relief under Section 139 -16(C) of the By -Law to validate the front yard set -back violation on the Property. A copy of this ZBA Decision, File No. 014 -12, is attached hereto as Exhibit "B ". The Applicant proposes to renovate the existing dwelling on the Property. Specifically, the Applicant proposes to build a second story to the main mass of the dwelling. A 135+/ - square foot portion of the dwelling where the applicant plans to add a second story will be located on the eastern side of the property and will encroach on the front yard set -back but will be no closer than 19.8 + /- feet from the front yard lot line. The structure is currently located 19.8 + /- feet from the front yard lot line. The proposed renovations will not change the footprint of the dwelling and will not change the ground cover for the Property. The proposed renovation and addition to the dwelling is in accordance with and pursuant to Certificate of Appropriateness No. 57750 issued by the Nantucket Historic District Commission on April 3, 2012, a copy of which is attached hereto as Exhibit "C ". 1 Granting the proposed Special Permit will not be substantially more detrimental to the neighborhood than the non - conforming dwelling on the Property. The proposed renovation and upward expansion to the existing dwelling is moderate in size and will not increase the non conforming distance of the current front yard set -back. More specifically, the proposed renovation will not be any closer to the front yard lot line than the already existing 19.8 + /- feet. The footprint of the dwelling and the ground cover for the Property will remain the same and no new non - conformities will be created. The renovated dwelling will be in harmony with other houses in this area of the Island. Also, by granting the requested Special Permit, the Board would be acting in a manner consistent with the spirit and intent of the Zoning By -Law. In the alternative, the Applicant requests a Variance for the above - proposed work on the Premises pursuant to Section 139 -32. As stated in the previous ZBA Decision for the Property, File No. 014 -12 (Exhibit `B "), due to the shape and topography of the lot and the structure thereon, the literal enforcement of the current thirty (30') foot front yard set -back would create a substantial hardship for the applicant. Further, granting this relief does not involve substantial detriment to the public good or a derogation of the intent of the By -law. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, February 9, 2012, at 1:00 P.M., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following Decision on the Application of SHARON LAMB, ARLINE A. SPENCE, LAWRENCE C. MANCHESTER, and SARAH A. HOLDGATE, Owners /Applicants, c/o 1 Henderson Drive, Nantucket, MA 02554, in connection with the property known as 14 Mayhew Lane, Nantucket, Massachusetts, File No. 014 -12, 2. The Applicants are requesting Special Permit relief pursuant to Nantucket Zoning By -law Section 139 -16 (Intensity Regulations), §C (Exceptions for Yards) and /or Variance relief pursuant to Section 139 -32 to validate the existing structure on the lot and grant relief for any existing groundcover and /or front yard setback nonconformities. The Applicants are seeking Special Permit relief and /or Variance relief to reduce the front yard set back which was 20' in 1979 when the house was constructed to approximately 19.8' to validate the structure as it is presently located on the lot. The house is located as shown on a Building Location Plan by Island Surveyors, LLC dated November 16, 2010. A Certificate of Occupancy was issued May 16, 2011. The current front yard set back in the R -20 zone is 30'. The Applicants are seeking Variance relief pursuant to Section 139 -32 to validate the existing house on the lot. The lot was created by a Plan dated January 6, 1984 and endorsed Approval Not Required by the Planning Board on January 14, 1985. All of the lots on the plan show existing structures. The structure on Lot 1 exceeds the permitted 12.5% ground cover ratio by approximately 31 +!- square feet. The property is located at 14 Mayhew Lane, Nantucket, Map 41, Parcel 447 and is zoned Residential — 20 and is shown as Lot 1 on Plan File 16 -E. Bk: 01316 Pg: 253 3. Our Decision is based upon the Application and accompanying materials, and representations and testimony received at our public hearing on February 9, 2012. The Planning Board made no recommendation, finding that the Application did not present issues of planning concern. There was no abutter comment either in favor of, or in opposition to, the application. 4. Applicants through their counsel explained that the front yard set back in the zone was 20' when the house was constructed in 1979 pursuant to Building Permit No. 1050 -79. The structure was built with a 19.8 + /- foot set back from Mayhew Lane as shown on as shown on a 1979 Plan filed at Plan Book 20, Page 78 and a Building Location Plan by Island Surveyors, LLC dated November 16, 2010. At the time of construction of the house in 1979, foundation plans and as- built plans were generally not required by the Building Department. Special Permit relief may be granted pursuant to 139 § 16 -C from Intensity Regulations for setback requirements set forth in Section 139 §16 for an unintentional intrusion in a front yard setback which is less than 5 feet. Applicants through their counsel explained that the property was reconfigured several times by a prior owner from 1974 through 1984 as shown on plans filed at Plan Book 18, Page 129, Plan Book 20, Page 78 and Plan File 16 -E. The 1979 plan showing the house on the property as Lot 1A with an area of 23,158 square feet would have had adequate lot area for the house with the existing ground cover. However, when the Lot was sold in 1986 by the original developer the property description reflects the1984, plan at Plan File 16 -E, showing the property as Lot 1 with an area of 20,301 square feet which created the nonconforming ground cover. The Board may specifically find that owing to circumstances relating to the soil conditions, shape or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located, a literal enforcement of the provisions of this chapter would involve substantial hardship, financial or otherwise, to the Applicant and the desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of such bylaw. The location of the turning -t as shown on the plan reduced the lot area available for the existing structure to meet the ground cover ratio in the district and does not generally affect the zoning district in which it is located, a literal enforcement of the provisions of this chapter would involve substantial hardship, financial or otherwise, to the Applicant and the desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of such bylaw. Accordingly, the Board of Appeals, by a unanimous vote (Toole, Botticelli, Koseatac, Poor, and Angelastro in favor), GRANTS, the relief by SPECIAL PERMIT to validate the existing front yard set back of 19.8 + /- feet and grants VARIANCE RELIEF to validate the groundcover of the existing structure on the relief of 2,568 + /- square feet as shown on the Building Location Plan by Island Surveyors, LLC dated November 16, 2010 attached hereto as Exhibit A and provide that no further relief is .required from this Board for interior renovations of the structure and no further relief is required from this Board for changes or alterations to the structure that do not increase ground cover and do not create any new zoning nonconformities. Applicants through their counsel explained that there is one single - family dwelling on the Property which was constructed in 1979. At the time the dwelling was constructed in 1979, the front yard set -back for the property was 20 feet. Currently, a small portion (135 + /- square feet) of the dwelling is sited as close as 19.8 + /- square feet from the front yard lot line in a zoning district that requires a front yard set -back of 30 feet.
