O'Mara, Kerim Koseatac, Lisa Botticelli, and Susan McCarthy. Board Members absent: Dale Waine, Mark Poor, and Michael Angelastro Staff. John Brescher Call to Order: Chairman Toole called the meeting to order at 1:05 PM. IL Approval of the agenda: A motion was made (O'Mara) and duly seconded to approve the agenda as written. The vote was 5 -0 in favor. III. Approval of the Minutes: A motion was made (Botticelli) and duly seconded to approve the minutes of February 1st, 2012 and February 9th, 2012. The vote was 5 -0 in favor. IV. Other Business: Technical Amendment Request — 34 1/2 Surfside Road Nominee Trust (File No. 075 -11) Lisa Solomon represented herself at the hearing. Ms. Solomon explained to the Board that she would like the condition of her decision requiring her to install a driveway apron be changed from a requirement of 12'x 18' to the standard in the Bylaw, which is 10'x 15'. A motion was made (Botticelli) and duly seconded to approve the requested relief as a technical amendment. The vote was 5 -0 in favor (Toole, O'Mara, Koseatac, Botticelli, McCarthy). V. Attorney Weinman submitted a revised parking plan for the Board to consider. The Board suggested modifying one of the proposed plans in order to accommodate 13 spaces and green space along the southwest corner of the Locus. A motion was made (Botticelli) and duly seconded to approve the requested relief. The vote was 5 -0 in favor (Toole, O'Mara, Koseatac, Botticelli, McCarthy). C Cohen C Water St. Cohen C Reade Attorney Gifford explained to the Board that the Applicant is proposing to fill in an old stoop towards the rear of the structure and that there will be nothing closer to the sideline setbacks than what presently exists. A motion was made (Koseatac) and duly seconded to approve the requested relief. The vote was 5 -0 in favor (Toole, O'Mara, Koseatac, Botticelli, McCarthy). Documents Referenced: . The Zoning Enforcement Officer, Marcus Silverstein, suggested to the Board that the Applicant may need to re- notice the application because the exterior storage associated with the business was never requested in the legal notice. The Board also suggested continuing the matter to review prior decisions for exterior storage in the neighborhood. A motion was made (McCarthy) and duly seconded to continue the matter to the April 121h hearing. Attorney Glidden explained to the Board that the Applicant is requesting Variance relief to validate the setback intrusion or, in the alternative, Special Permit relief in order to reconfigure the lot lines to cure the existing setback intrusion. A motion was made (O'Mara) and duly seconded to approve the requested Special Permit relief. The vote was 5 -0 in favor (Toole, O'Mara, Koseatac, Botticelli, McCarthy). Attorney Dale explained the scope of the work proposed by the Applicant and the need for Variance relief. The Board suggested that the Applicant reconsider the plans and come back to the Board in April with a revised project. A motion was made (O'Mara) and duly seconded to continue the matter to the April 121h hearing. The vote was 5 -0 in favor. 017 -12 Connelly Action Deadline June 6, 2012. 54 Hulbert Avenue Hunter Attorney William F. Hunter represented the Applicant. Attorney Hunter explained to the Board that the proposed renovation will not increase the nonconforming nature of the project. An abutter, Mary Ferguson, asked when the work would be completed and whether or not there would be a second story addition on the easterly side of the structure. Attorney Hunter explained that the work would be done during the off - season and that no such addition has been planned. Mr. Palenski explained to the Board that the Applicant would like to extend his structure into the setback in order to construct an addition. The Board requested additional plans in order to see precisely how far into the setback this addition would intrude. An abutter spoke to the application and requested that the work be performed during the off - season. A motion was made ( Koseatac) and duly seconded to continue the matter to the April 121h hearing. The vote was 5 -0 in favor. VII.
