Pursuant to a lease from the Town of Nantucket, the applicant,
Nantucket Community Sailing, Inc., a Massachusetts nonprofit,
charitable corporation whose purposes include instructional and
recreational sailing activities, proposes to construct a shed to be
used as a support building in connection with instructional sailing
programs conducted in the adjacent waters of Polpis Harbor, uses of
the building including instruction and storage of materials used in
connection therewith. The locus consists of two undersized,
nonconforming lots which came into existence after the effective
date of the original Nantucket zoning by -law in 1972, which were
acquired by the Town of Nantucket on December 13, 1982, for the
purpose of providing public access to Polpis Harbor, including the
launching of boats. Together, these lots, as considered together
as a single lot for zoning purposes, are nonconforming with the
dimensional zoning requirements under Nantucket Zoning By -law §139 -
16.A in the Limited Use General -3 ( "LUG -311) zoning district of
120,000 square feet in lot area and 200 feet of frontage, and do
not conform to the regularity formula under By -law §139 -16.D. As
shown upon the plan by Blackwell & Associates, Inc., which is
submitted with this application, the locus contains 26,234± square
feet in area, and frontage on Wauwinet Road is 20.51 feet. Since
the locus does not constitute a pre- existing, nonconforming lot of
record, a variance from these dimensional requirements is necessary
in order to construct any structure upon it, and such variances are
hereby requested. The intended instructional use by the applicant
is exempt from zoning requirements because it constitutes an
educational use by a nonprofit entity; in the alternative, the
applicant requests relief by special permit under By -law §139 -7.A,
for the proposed structure as a part of a recreational use.
