Minutes of the Meeting of 2 June 2008 at 9:30 AM. The meeting took place in the 1 st floor
Conference Room, Town and County Building, 16 Broad Street, Nantucket, MA 02554. Members
of the Board present were Patricia Roggeveen, Brian Chadwick, Allen Reinhard, Michael Kopko
and Rick Atherton. Chairman Kopko called the meeting to order at 9:30 AM.
Review and Determination as to Responsibility for Payment of Legal Bill Associated with Reis
Trucking Site Assignment Hearings (continued from 21 May 2008: 28 May 2008). Ms. Roggeveen
reviewed her concerns, as expressed at the Board of Health meetings of May 21, 2008 and May
28, 2008 with regard to payment of legal bills associated with the Reis Trucking site assignment
hearings. Mr. Chadwick stated he is more concerned with the bill itself, rather than who pays it. Ms.
Roggeveen stated she expects issues (i.e. scope of services) with Town Counsel to be more
"formalized" in the future and that some portion of this bill should be covered by the Town's legal
retainer with Deutsch Williams. Chairman Kopko expressed his opinion that payment of the bill
should be negotiated with Town Counsel due to the disputed amounts. Mr. Reinhard expressed an
overall concern as to the expense of the site assignment hearing (which could financially benefit a
private company). After some discussion, Ms. Roggeveen moved that she and Mr. Chadwick
negotiate the bill with Town Counsel so that Reis and the Town would each pay half of the invoice
and, if Reis refuses payment, refer the matter to the site assignment Hearing Officer and, to
develop specific protocols with Town Counsel regarding scope of services for future matters that
may not be straight - forward and are not clear as to being covered by the Town's retainer;
seconded by Mr. Reinhard. So voted. Mr. Atherton abstained.
The meeting was unanimously adjourned at 9:45 AM.
