NANTUCKET SUPERIOR COURTROOM
MEMBERS PRESENT: Chairman Willauer, Mr. Reinhard, Mr. Chadwick, Ms.
Roggeveen and Mr. Kopko
MEMBERS ABSENT: None.
Meeting called to order at 6:00 p.m.
AGENDA
Concerns for the Board of Health. None noted.
Three tight tank requests. Three properties with substantial erosion and no other
alternative for a septic system.
1. Variance request — 34 Massachusetts — tight tank. This is a property on the end of
Mass Ave on the left side. The septic system is non - existent due to erosion and
the house has been moved. HO Ray recommends granting approval for tight tank
use with these criteria: tight tank is a minimum of 2,000 gallon with a warning
system in place when the tank is 2/3 full; a contract must be secured with a local
pumping contractor and inspected frequently; 6 months maximum usage; and an
agreement with the DPW with a user fee in place. Following local approval,
applicant must get DEP approval.
Jeff Willet of the DPW is asked some questions about tight tank usage. He is
concerned that additions of tight tanks will displace others in the sewer district.
HO Ray asks Mr. Willett how long will it take to get a privilege fee established.
HO Ray will not actually permit these tight tanks until a privilege fee is in place.
BOH unanimously approves tight tank with stipulations.
2. Variance request - 45 Massachusetts Ave — tight tank. This property is at the end
of Mass Ave on the right hand side. This is also an erosion problem and relocation is
necessary. HO Ray recommends approval of tight tank with stipulations in place.

3. Variance request — 289 Hummock Pond Rd. — tight tank. This home is the last
house on the right near Hummock Pond on an eroding bank. This will utilize a
2,500 gallon tank (approved by ConCom). HO Ray recommends approval with
stipulations in place.
BOH unanimously approves tight tank with stipulations.
HO Ray discusses Barnstable County's/DEP's results on testing of alternative design
septic systems which have recently become available. The 19 mg/nitrogen cutoff level
for state water quality issues have not been met by some systems. Some of the systems
approved for usage have not been performing as well as expected by the state. We as a
local BOH may be recommending certain systems for use as a result of this information.
4. Pinto's Island Fruit and Produce — request for a six -month extension on flooring
replacement. HO Ray recommends denial of a six -month extension as stated
during last month's BOH meeting.
Mrs. Pinto says that relative to the first issue, the bathroom, that Amelia Properties
Ltd. has contacted Bob Ramos Plumbing and Heating to begin construction of the
bathroom as soon as possible at the owner's expense. The second issue, the flooring,
Island Produce will install appropriate flooring which will meet code of requirements
of the Health Department. They are requesting an extension to July due to financial
hardship.
HO Ray responds that the floor has been an on -going problem for over five months
and he does not recommend extension. The location will not be licensable until the
new floor is installed and as of January 24th, must be closed.
Mr. Kopko states that you are asking the Health Department to make the rules
different for you than for others on the island.
Mr. Chadwick asks about Island Produce's lack of a bathroom.
Mr. Pinto responds that they no longer have a dedicated bathroom. The owner,
Amelia Properties, is going to put a bathroom in or work with the plumbing
department to get it rectified.
Ms. Roggeveen asks HO Ray to clarify the health issues with the current floor.
HO Ray discusses the bubble, rippling and tear in the floor.

Mr. Reinhard states that there is an overriding public health issue and doesn't
understand why the issue wasn't dealt with when brought to the owner's attention
prior to this meeting. Mr. Reinhard is in favor of upholding the health inspector's
recommendation not to extend the license.
The BOH unanimously denies Island Fruit and Produce's request for a six -month
extension.
Mr. Willauer asks for any concerns for the Board. None noted.
The BOH is adjourned at 6:45 p.m.
