MINUTES — AUGUST 22, 2007

Meeting called to order at 6:00 p.m.
AGENDA
1. Any questions /concerns from the public. None noted.
2. Minutes from June 27, 2007 approved unanimously.
3. Variance Request - Waiver of penalty fee for One Love Market. HO Ray states
that One Love Market was open prior to licensure. Therefore, the penalty is four
times the license fee.
One Love Market owner says they were not open for business.
Both Artell Crowley, Assistant Health Officer and Hank Ross, Summer Food
Inspector state that there was no construction going on, the store was fully
stocked, the door was open and unlocked and the owner admitted that the cash
register had approximately $200.00 in it. Also witnessed was a customer at the
cash register counter with items placed on the counter for purchase.
BOH unanimously denies waiver of penalty fee.
4. Status of Proposed Long -Term Rental Regulations - HO Ray states that the
regulations have been before the Board for 9 months, there has been a public
forum and a workgroup. HO Ray asks the Board what direction the Health
Department should take at this time?
BOH members ask if current applicable laws would work if additional manpower
were hired.
HO Ray states that if additional manpower were hired, the illegal, substandard
housing that exists today could be addressed. However, with no
permitting/licensing authority and no extra revenue, it would be a waste of the
town's money.

If the Board adopts the regulations, and an effective date of July 1, 2008 were in
place, the Finance Committee would have to agree to move funds into the Health
Department's budget.
Chairman Willauer suggests that a public hearing be scheduled attended by
housing inspectors from the Cape. Mr. Kopko also suggests another workgroup
session if the Cape housing inspectors cannot attend.
HO Ray agrees to meet sometime during the end of September or in early
October.
5. Chairman Willauer and HO Ray announce that the DEP will present the
final estuaries report on Nantucket Harbor water quality on August 28th at 6:00
p.m. at the LGI. Approximately two weeks after that, DEP will present to the
town the TMDL. It is suggested that this be presented to the BOH.
BOH adjourns at approximately 6:43 p.m.
