MINUTES — FEBRUARY 28, 2007

and Mr. Bennett

Meeting called to order at 6:00 p.m.
Chairman Willauer asks for concerns from the public. None noted.

BOH unanimously approves minutes of November 29, 2006, January 24, 2007 and February ,
2007. o
Variance Request — 3 Sheep Pond Rd. — tight tank. This is an existing home. Due to beach
erosion, reduction in square footage of the property and the position of the well, HO Ray
recommends approval of a tight tank with the following stipulations:
1. DEP approval must be obtained for tight tank installation following approval of
variance request by the BOH;
2. all work requiring installation of the tight tank must be completed prior to occupancy
of the dwelling;
3. the tank shall be a minimum of 2,000 gallons
4. there shall be a monitoring alarm system set at 1,800 gallons;
5. the structure shall remain seasonal in use — April through October; and
6. a yearly, renewable contract shall be in force between the owner of the property and a
local pump -out service, and shall be monitored by that pump -out service monthly
during the use of the structure.
BOH approves variance request with stipulations unanimously.
HO Ray updates BOH on the utilization of tight tanks in both harbor watershed protection
districts. In Madaket Harbor Watershed Protection District, there would be approximately 12 -20
estimated tight tanks, mainly in the Tennessee Avenue/Hither Creek area which would be for
existing homes /existing septic systems on undersized lots. In the Nantucket Harbor Watershed
Protection District, HO Ray estimates there would be 12 -20 tight tanks. The state has agreed to
usage of right tanks on a case -by -case basis with a five -year window, on homes with septic
systems that have no other alternative at this time. DEP will review our wastewater plan and our
septic management plan. Also, the Town of Nantucket will receive TMDL figures within the
next five years. HO Ray informs the BOH that the meeting with DEP in Boston will not be
needed at this time.
