TOWN OF NANTUCKET
MINUTES — JULY 22, 2009
NANTUCKET SUPERIOR COURTROOM
MEMBERS PRESENT: Chairman Kopko, Ms. Roggeveen, Mr. Chadwick, Mr. Atherton
and Mr. Reinhard
MEMBERS ABSENT: None
Chairman Kopko calls the meeting to order at 6:12 p.m. and asks for public
comments /concerns. None noted.
AGENDA
The minutes of April 22, 2009 are approved unanimously.
Variance Requests
1. 68 Arkansas Ave. — This is a replacement of a failed septic system from a HWS
inspection. They are requesting sideline setbacks and relocation of the system.
HO Ray recommends granting variance — it meets maximum feasible compliance.
The variance request is approved unanimously.
2. 7 S. Cambridge St. — This is for the proposed racquet club and is a composting
toilet proposal as well as sideline setback variance request (sideline setbacks are
routine, in -house approval). This system has been approved by DEP and will
have no reserve area setback due to property constraints. It will have minimal
impact on groundwater due to composting toilets. HO Ray recommends granting
variance. The BOH approves the variance request unanimously.
3. 347 & 355 Madaket Rd. & 4 Ames Ave. — HO Ray has a document requiring
BOH signature for three structures directly at the end of Madaket Road. This is
for a shared septic system which replaces a non -code compliant system. The
shared septic system will have less disturbance than a traditional system and fits
all criteria as mandated by DEP and Nantucket Board of Health. The document
needs BOH signatures and HO Ray recommends signing it — this grants
permission to utilize a shared system and monitoring will be required. BOH
unanimously approves signing of document.
4. Request of Waiver of Penalty to Star of the Sea Youth Hostel — HO Ray states
that this is the third year in a row that the youth hostel has opened without benefit
of a permit. The new manager (Jenna Dubois ?) states that she is trying to comply,
but as this is her first year, she didn't realize she had to get a lodging/dorm permit.
She had the water tested and got her building/fire inspections, just not her health
inspection and was unclear as to how to maneuver the system as management has
changed frequently over the past several years. Mr. Reinhard recommends making
the fine $200.00. Mr. Chadwick and Ms. Roggeveen can't support a waiver of the
fine. The BOH votes 4 -1 to deny waiver of penalty request.
BOH Update
HO Ray has proposed regulations for Madaket with regard to wastewater reduction in
Madaket. He would like to set a hearing date for Madaket regulations at the Admiralty
Club on August 24th at 4:00 p.m. The BOH agrees to this request.
Tick -Borne Disease Committee — HO Ray tells the BOH that the committee is meeting
frequently, has a defined schedule and work plan, is looking at all aspects of the disease
and will make their recommendation to the BOH sometime this fall.
Also, Miacomet Pond will be closed for swimming due to high bacteria levels and will be
resample next Tuesday. Warren's Landing is being retested tomorrow, as high bacterial
levels were found there as well.
