Date: Februaj-�T 14, 2006 Re: Variance request from the Madaket Regulations Dear Board members, Please find enclosed correspondence from Arthur Gasbarro of Blackwell & Associates requesting waivers from sections 51.02, A 8s B, Distances of the Town of Nantucket Board of Health Regulations Affecting, Madaket. • The property- in question is outside the Madaket Harbor Protection District and contains a garage and a single family dwelling serviced by a currently failing system. As is noted on the enclosed plans, over 90% of the property is unusable for septic system design due to placement of abutter's wells. In noting the previous, the only appropriate location for the leach facility is in the south west corner of the property abutting Hampshire Avenue. Thusly, distance waivers are required for placement of the leach facility closer to the roadway while maintaining a maximum distance away from abutters wells. Also, the owners of the property will be installing and alternative design system for nitrogen reduction. Recommendation: This Office recommends granting the above noted variance with the stipulation that a maintenance agreement for the alternative design system be provided to the Health Department annually for the life of the system. • To: Board of Health — Town of Nantucket ti From: Richard Ray — Director — Nantucket Health Department Date: April 3, 2006 v Re: Variance request from Title Five — 63 Wanoma Way Dear Board Members, Please fine enclosed correspondence from Blackwell & Associates requesting waivers from denoted sections of The State Environmental Code — Title Five. The property in question is located in Tom Nevers and encompasses substantial areas of barrier beach. Currently, the property contains an existing 4 bedroom dwelling with a non code compliant septic system. In seeking a repair to this system, the proponents are proposing to install an alternative /innovative system in order to receive the approvable 50% reduction in leach facility sizing to offer minimal impact on the existing primary dune on the property. Even with the 50 % reduction in leach facility size, the system encroaches upon sideline setbacks due to abutters well placements and the primary dune which will be 85 feet from the leach facility instead of the required 100 feet. RECOMMENDATION This office recommends granting the above noted variance with the following provision(s). 1. The property owners will be required to furnish this Department with a signed maintenance agreement prior to the occupancy of the residence. Said agreement shall remain in agreement for the life of the system.
