BENNETT MEMBERS ABSENT: None. Meeting called to order at approximately 7:00 p.m. Public comment/concerns: None noted. AGENDA Board of Health minutes of May 4, 2005 and May 25, 2005 approved unanimously. Updates: HO Ray gives BOH a brief Septic Management Plan update and states that this will be presented to BOH in September. Variance Requests 1. 30 New Hampshire Ave. — Emergency variance request for a failed well. The well will not meet the 150' separation requirement in Madaket. However, with the eroding coastal bank and the owners' meeting maximum feasible compliance, HO Ray recommends granting variance request to move the well. Motion to grant variance request approved unanimously. 2. 84 Quidnet Rd. — This is a failed septic system that will utilize an alternative design system. HO Ray recommends granting the variance with the stipulation that a signed maintenance agreement be in place for the life of the system. Motion to grant variance request with stipulation approved unanimously. 3. 12 Washington Ave. — This a failed septic system on an existing structure where maximum feasible compliance is met. HO Ray recommends granting variance with the stipulation that a signed maintenance agreement be in place for the life of the system. Motion to grant variance request with stipulation approved unanimously. 4. 16 Tennessee Ave. — Existing structure(s) with a failed septic system. Health Office records indicate structure with a two bedroom septic system servicing the BOARD OF HEALTH MINUTES — AUGUST 3, 2005 largest part of the property. A second septic system was discovered (consisting of a cesspool) servicing this property. The Health Officer, the engineers and the property owner agree that this is a four bedroom dwelling. The property owner has requested a five bedroom septic system because there is an ancillary building on the property (which to HO Ray's knowledge has been altered without benefit of a building permit) to reflect a studio with a functioning bathroom and a large room to be used as a study, workshop, or for sleeping purposes. Our local definitions of a studio (with a bathroom) is defined as a bedroom. There is now a five bedroom arrangement being fed into a four bedroom septic system. Owners have asked for an alternative design system to encompass five bedrooms. The BOH has two options. Option 1 — HO Ray recommends denying the variance as presented as the actual bedroom count exceeds the maximum design flow for the property. Option 2 — HO Ray recommends granting the variance with a stipulation that the bathroom in the ancillary structure must be removed in its entirety with a permit from the building department, a maintenance contract must be secured for the proposed alternative design system and must be renewed upon expiration for the life of the system. HO Ray recommends granting variance only with the removal of the bathroom in the ancillary structure. BOH denies variance request as presented unanimously. Owner may remove bathroom to comply with HO Ray's recommendation and resubmit request. BOH Updates HO Ray updates the Board of Health regarding the upcoming mosquito symposium that the public is invited to attend. The public needs to walk their property frequently for removal of standing water. The public needs to be aware of ticks and to check themselves frequently. Mr. Willauer would like to have a tick proposal submitted for the next BOH meeting for discussion. BOH meeting adjourned at approximately 7:45 p.m. 2
