HomeMy WebLinkAbout2005-9-15BOARD OF HEALTH TOWN OF NANTUCKET PUBLIC HEARING — September 15, 2005 NANTUCKET HIGH SCHOOL CAFETERIA MEMBERS PRESENT: Chairman Glowacki, Mr. Watts, Mr. Chadwick, Mr. Willauer, and Mr. Bennett MEMBERS ABSENT: None. Meeting called to order at 4:00 p.m. Chairman Glowacki asks for public comment/concerns. None noted. AGENDA 1. Amendment of BOH Fee Schedule. HO Ray discusses changes to fee schedules for the Health Department. Changes in the penalty section are: any operation or installation without benefit of a permit from the BOH will result in a penalty of four times the permit fee. New fees for the Health Department are: $100.00 to relocate a septic tank; and $100.00 to install an ejector pump; witness fees for perk tests (island wide) and septic system inspection witness fees (within the harbor protection district) are $150.00 for the first three hours and will be billed out at $50.00 per hour after the third hour. Chairman Glowacki asks for questions /comments from the public. 1. Larry Wheldon: Is the new fee schedule punitive in nature? HO Ray: yes. Chairman Glowacki asks for BOH questions /comments. 1. Do restaurants need a new permit to open on Memorial Day? (Mr. Willauer) HO Ray: Yes, all business permits expire on December 31St Chairman Glowacki closes the Public Hearing on Fee Schedule Changes /Amendments. The BOH fee amendments /increases are approved unanimously effective October 1, 2005. BOARD OF HEALTH PUBLIC HEARING — September 15, 2005 2. Escrow Language — BOH Reg. 68.00 HO Ray: This in an inclusion into our existing regulations relative to the Harbor Watershed Protection District. The escrow account is to be utilized for the repair of a failed septic system within the Nantucket Harbor Watershed Protection District and allows individuals an extended period of time to repair their failed septic system due to the fact that new regulatory changes from DEP may be approved which would allow individuals to utilize a more inexpensive system. We will ask individuals/homeowners to put $50,000.00 into an escrow account for use with a grey water system (if approved), an alternative design system or a regular septic system. There are also a few verbiage changes HO Ray would like implemented: Pg. 3, Section B2 reads....a certified system permit Change to.... Construction Works Permit Pg. 4, Section 3, seventh line from the bottom reads... install Delete install and change to ... effect the installation of... Chairman Glowacki asks for questions /comments from BOH. 1. Could we lower the escrow amount to $40,000.00? (Mr. Watts) HO Ray: The Health Department agrees to lower the escrow sum to $40,000.00. 2. Are there systems in excess of $40,000.00 being put in? (Mr. Chadwick) HO Ray: Yes, but that would be the responsibility of the homeowner. Chairman Glowacki asks for public comment/questions. None noted. Motion made to approve amendments to escrow account, to lower the escrow amount to $40,000.00 (effective as of October 1, 2005), and to close the public hearing - approved unanimously.
