IN ATTENDANCE: Mr. Soverino, Mr. Spriggs, Mr. Fee, Mr. Bender and Mr. Santos-i> 1. Concerns from the Public - None noted 2. Old Business - Request for relief from the New Food Code from Aunt Leah's Fudge - (Continued from March 13, 2002) ;a HO Ray - This is a request for relief from the New Federal Food Code requiring that a mop sink be provided in all Food Service Establishments. No grandfathf-ing is allowed from this section of the Code. Mr. Foster Herman is representing Aunt Leah's Fudge. They have not provided this sink and feel that they do not need to due to the size of their business. We (the Health Dept) believe that the sink is a necessity for a number of reasons: business has ex- panded from a Fudge Shop to also selling packaged candy, hot dogs, donuts, coffee, etc. We have had some issues with the cleanliness of the floor on our inspections. We would like to see the three - compartment sink used for its design which is to wash, rinse and sanitize and that a mop sink be installed and we believe that there is room for one in the establishment. We believe it is not a burden and all the others have complied. Mr. Soverino - I know there are public restrooms provided on the premises - does that give you any latitude in allowing the handwashing to be done in the bathrooms as he point out that he already has four sinks on premise? HO Ray - No. He does already have four sinks, but three of these sinks are an attached three - compartment sink, the other very small sink is exclusively for hand washing in the food prep area, bathroom sinks do not count as a separate, exclusive mop sink, which is now required. Mr. Soverino - May the mop sink be located in the restrooms? HO Ray - We would not routinely do that, it must be conveniently located. However, if there is no better way, Mr. Crowley would, I believe, allow that. We would want it to be were it is practical and easily usable. Mr. Spriggs - Moves to not approve variance per HO Ray's recommendation. BOH Approves motion 4 -0 with Mr. Fee abstaining BOH adjourns at app. 8 p.m.
