DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, March 8, 2012, at 1:00 P.M.; Thursday,
April 12, 2012 at 1:00 P.M.; and Thursday, May 10, 2012 at 1:00
P.M. at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board
made the following decision on the application of DARIUS TORABY,
TRUSTEE OF THE JUSO REALTY TRUST, 31 Strickland Road, Cos Cob,
Connecticut 06807, File No. 020 -12:
2. Applicant is requesting Special Permit relief pursuant
to Nantucket Zoning Bylaw Section 139 -33.A. (preexisting
nonconforming structures) in order to extend the preexisting
nonconforming structure closer to the rear yard setback than the
existing structure. The structure is presently nonconforming as
to side and rear yard setbacks, being sited as close as 3.1 feet
from the northerly side lot line, 4.4 feet from the easterly
rear lot line, and 2.8 feet from the southerly side yard lot
line, in a zoning district that requires a five (5) foot side
and rear yard lot line. The Applicant proposes to extend the
rear of the structure such that it may be no closer to the
easterly side yard lot line than 4.0 feet. In the alternative,
the Applicant is requesting Variance relief pursuant to
Nantucket Zoning Bylaw Section 139 -32 (Variances) from the
setback requirements in Section 139 -16 (intensity regulations -
setbacks). The Locus is situated at 11 Bank Street, Siasconset,
is shown on Nantucket Tax Assessor's Map 73.1.3 as Parcel 67, is
shown on Land Court Plan 39172 -A, and title is registered as
Certificate of Title No. 19,612

3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. The owners of a property abutting the locus
appeared at the initial public hearing and asked that there be a
restriction on exterior construction during the summer months.
Otherwise, there was no support nor opposition presented at the
public hearing except for the presentation by the applicants'
representative.
4. Paul Palenski represented the Applicant. Mr. Palenski
explained to the Board the Applicant is requesting Special
Permit relief pursuant to Nantucket Zoning Bylaw Section 139 -
33.A. in order to extent the preexisting nonconforming structure
as close as 4.2 feet from the easterly side yard lot line in a
zoning district that requires a five (5) foot side yard setback.
The structure is presently sited as close as 4.4 feet from the
easterly side yard setback and the Applicant is requesting to
extend the structure further in order to site a column.
The structure is presently nonconforming as to side and rear
yard setbacks, being sited as close as 3.1 feet from the
northerly side lot line, 4.4 feet from the easterly rear lot
line, and 2.8 feet from the southerly side yard lot line, in a
zoning district that requires a five (5) foot side and rear yard
lot line. In the alternative, the Applicant is requesting
Variance relief pursuant to Nantucket Zoning Bylaw Section 139-
32 (Variances) from the setback requirements in Section 139 -16
(intensity regulations - setbacks).
At the March 8th hearing, the Board suggested the Applicant
provide a revised site plan that would show the exact location
of the proposed extension and further suggested that the
extension be no further into the setback than the existing
structure, which is sited as close as 4.4 feet from the lot
line.
At the May 10th hearing, the Applicant's representative provided
the Board with a site plan showing the proposed alteration sited
approximately 4.4 feet from the rear yard lot line.

5. Upon these facts, the Board of Appeals, by unanimous
vote, made the finding that the proposed alterations to extend
the structure so that it is no closer to the rear yard lot line
than the existing 4.4 feet would not be substantially more
detrimental to the neighborhood than the existing
nonconformities, and granted the requested relief by Special
Permit to authorize this alteration and extension, subject to
the following conditions:
(a) All work shall be done in substantial conformity
to the plan entitled "Zoning Board of Appeals Site Plan,"
prepared by Charles W. Hart and Associates, Inc., dated July 31,
2012, attached hereto as "Exhibit A "; and,
(b) No exterior construction shall take place between
Memorial Day and Labor Day in any year.
