Proposal
Applicants are seeking relief by Special Permit under Zoning By -Law
Section 139 -33E to allow construction of a new Attic Floor addition of 84SF
to an existing two - and - one -half story, single - family dwelling in the ROH
Zoning District. Note: This addition is entirely within the existing building
footprint and will not increase groundcover. The current dwelling is pre-
existing, non - conforming with respect to front yard setback, being 0.2 feet
over the front lot line in a district which allows Zero feet front yard setback,
and being as close as 0.9 feet to the south side yard lot line in a Zoning
District requiring a side yard setback of 5 feet. Note: This new addition
conforms to all setbacks.
This dwelling has one parking space as required by Zoning.

1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, February 9, 2012, at 4 Fairgrounds Road,
Nantucket, Massachusetts, the Board made the following decision
on the application of DOUGLASS BERMINGHAM, c/o Nathan B.
McMullen, 8 Austin Farm Drive, Nantucket, MA 02554, File No.
009 -12:
2. Applicants are requesting Special Permit pursuant to
Nantucket Zoning Bylaw Section 139- 33.A.(4) and (5) (alteration
of preexisting nonconforming structures) in order to alter the
preexisting nonconforming single- family dwelling without
increasing the nonconforming nature of the structure. The
Applicants propose to construct a new attic floor addition that
will be entirely within the existing building footprint and not
increase the groundcover on the Locus. The structure is
nonconforming as to front yard setback, being sited over the
front yard setback by 0.2 feet in a zoning district that
requires a zero (0) foot front yard setback, and to side yard
setback, being sited as close as 0.9 feet from the southerly
side yard setback in a zoning district that requires a five (5)
foot side yard setback. The proposed alteration will conform to
all setback requirements of the Bylaw. In the alternative, the
Applicant is requesting Variance relief pursuant to Nantucket
Zoning Bylaw Section 139 -32 (variances) from the intensity
regulations in Section 139 -16 (setbacks) in order to perform the
work requested. The Locus is situated at 10 Pine Street, is
shown on Nantucket Tax Assessor's Map 42.3.2 as Parcel 58, is
shown as Plan File 43 -Y, and is recorded in the Nantucket County
Registry of Deeds in Book 432, Page 97. The property is zoned
Residential Old Historic.

4. Nathan McMullen represented the Applicant at the
hearing. Mr. McMullen explained to the Board that the Applicant
is requesting Special Permit relief pursuant to Nantucket Zoning
Bylaw Section 139- 33.A.(4) and (5) in order to alter the

increasing the nonconforming nature of said structure.
The Applicants propose to construct a new attic floor addition

S. Therefore, after a discussion with the agent for the
Applicant, the Board finds that such a Special Permit relief
pursuant to Nantucket Zoning Bylaw Section 139- 33.A.(4) and (5)
in order to alter the preexisting nonconforming single - family
dwelling by constructing an attic floor addition to the
structure would not increase the nonconforming nature of the
structure and would not be any more detrimental to the
neighborhood than the existing nonconformity because said
addition will be outside the existing setbacks. The Board of
Appeals so finds that this type of alteration would be in
harmony with the general purpose and intent of the Zoning Bylaw.
6. Accordingly, by a UNANIMOUS vote of the sitting Board,
the Board of Appeals made the finding that such Special Permit
relief pursuant to Nantucket Zoning Bylaw Section 139- 33.A.4)
and (5) in order to alter the preexisting nonconforming single -
family dwelling without increasing the nonconforming nature of
the structure would not be any more detrimental to the

neighborhood than the existing nonconformity and would be in
harmony with the general purpose and intent of the Zoning Bylaw
with the condition that all work shall be done as shown on the
site plan labeled, "Building Location Plan of Land in Nantucket,
Mass, dated May 10, 1995, prepared by Charles W. Hart &
Associates, Inc., as modified by Nathan McMullen, attached
hereto as "Exhibit A" with the condition that there shall be no
exterior construction between Memorial Day and Labor Day of any
year.
