The dwelling was constructed by a prior owner during a zoning freeze period, in which the dimensional zoning requirements were those applicable in the Residential -1 zoning district in which the locus was situated at the time of filing of the subdivision plan for the tract which included the locus. Under the Residential -1 zoning, minimum front yard setback was 10 feet and minimum side yard setback was 5 feet. The dwelling upon the locus is situated about 6.7 feet from the southerly side lot line, about 6.8 feet from the northerly side lot line, and about 26.4 feet from the front lot line, each as measured at the closest point. Under the present Sconset Residential -20 zoning, minimum side and rear setback is 10 feet and minimum front yard setback is 30 feet. The proposed work will include changes within the portions of the existing footprint which lie within the side yard setback area, but will not extend further into those setback areas, and a reconfiguration and extension within the front yard setback area which will not be closer to the front lot line than the present structure. The dwelling conforms, and will continue to conform, to present requirements in all other respects, including rear yard setback and ground cover (as to which the applicable maximum is 1,500 square feet for this lot of record). The locus contains about 7,056 square feet and has 70 feet of frontage; minimum lot area as applicable when the lot was created, conveyed into separate ownership, and built upon was 5,000 square feet, and minimum frontage at that time was 50 feet. The applicants propose to alter their pre- existing, nonconforming single- family dwelling by constructing an addition which will not extend further into any setback area than any portion of the dwelling which is situated within that setback area and will conform to the ground cover ratio and all other dimensional zoning requirements. The subject property is situated at 16 TOWADDY LANE, SIASCONSET, is shown on Assessor's Map 49.3.2 as Parcel 15.1, is shown upon plan recorded with Nantucket Deeds in Plan File 9 -E as Lot 2, and is within the Sconset Residental -20 zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that no matter of zoning concern was presented by the application. Except for the presentation by the applicants' counsel, there was no support nor opposition presented at the public hearing. 4. As presented by the applicants' representative, they propose to alter the existing structure, which has pre- existing, nonconforming status because it conformed to zoning requirements during the zoning freeze period in which it was constructed and became nonconforming as a result of the zoning changes which occurred after the freeze rights attached to the property. The extensions will involve some construction outside the existing footprint, and some upward expansion within the setback areas, but the structure's setback at the closest point to the lot line in each of the areas in which it is nonconforming will not be less than the existing setbacks in those areas. Attached hereto as Exhibit A is a plan by Earle & Sullivan, Inc., dated March 29, 2010, depicting present conditions upon the locus, and attached hereto as Exhibit B is a plan by Earle & Sullivan, Inc., dated January 31, 2012, which depicts the proposed changes. The proposed changes have been approved by the Nantucket Historic District Commission ( "HDC ") under Certificates of Appropriateness Nos. 57094, 57095 and 57426. 5. Based upon this presentation, and in the absence of any opposition, the Board of Appeals, by unanimous vote, made the finding that the proposed alterations will not be substantially more detrimental to the neighborhood than the existing nonconformities, and accordingly granted relief by Special Permit to allow the proposed alterations, subject to the following conditions: (a) No exterior work shall be performed between June 15 and September 15 in any year; and (b) All work shall be performed in substantial conformity with HDC Certificates of Appropriateness Nos. 57094, 57095 and 57426.
