The meeting took place at Town of Nantucket's Community Meeting Room, First Floor, 4 Fairgrounds Rd, Nantucket. Present: Chairman Daniel Drake Vice Chair Arthur Gasbarro Commissioner Sheila O'Brien Egan Commissioner Carl England Commissioner David Gray Town Labor Counsel John "Jack" Dolan — Manager Al Peterson Counsel Kevin Batt — Audio Recording Meeting Meeting called to order at 6:40 p.m. following an Open Session meeting, to discuss the discipline or dismissal of, or complaints or charges brought against the Airport Manager. The following is a summary of topics and actions; it is not intended to be a transcript. Drake: Here to discuss possible settlement agreement. Peterson can request the meeting return to open session at any time. Drake/England/Egan: Each have spoken with Peterson about the matter. Peterson: Considers contract valid, and wants 6- months salary plus benefits as enumerated in the purported contract. He estimates the value at $140k. Dolan: Suggests a lump -sum approach to settle. Peterson: The Commission can make this simple or hard. He wants to be rewarded for his service. Batt: Believes Peterson contract to be valid. Dolan: Believes contract would likely be judged non - valid. England: Pay Peterson per purported contract. Gasbarro: Purported contract should be challenged. Drake: Motion: Terminate the Manager effective immediately subject to paying him $100k lump sum in return for the Manager agreeing to a general release. England: Seconds the Motion Batt: Wants indemnification for Peterson under the MA Tort Claims Act. Dolan: It would not extend protection for criminal activity. Drake: Agreed Peterson: Would like to be on through remainder of the current payroll period, which would end on Friday. Drake: Agreed Roll Call on the Amended Motion: Drake - Aye Egan — Aye England — Aye Gasbarro — Nay Gray — Nay Peterson: Would like to keep his phone number, and plane in the hangar for no charge through the winter. England: Motion: Manager may keep his plane in the hangar through March 2011 at no charge.
