The meeting took place at Town of Nantucket's Conference Room, 16 Broad Street, Nantucket. Present: Chairman Daniel Drake Vice Chair Arthur Gasbarro Commissioner Sheila O'Brien Egan Commissioner Carl England Commissioner David Gray Town Labor Counsel John "Jack" Dolan Meeting called to order at 4:25 p.m. following an Open Session meeting, to conduct strategy session in preparation for contract negotiations with the airport manager. The following is a summary of topics and actions; it is not intended to be a transcript. Dolan: Peterson refused offer. He wants 6- months salary plus benefits in order to agree to leave and sign a release. Dolan: Alternatives: 1) Do Nothing 2) Make counter - proposal or accept his demand 3) Schedule meeting to terminate without cause on the basis that the purported contract is not valid, and that he is an employee at will. 4) Perform internal investigation to discharge with cause Dolan: Recommends discharge without cause. He believes the purported contract would be deemed invalid, but there is risk that would not be the case. Dolan: Discharge with cause is similar to a mini - trial, and would take much preparation work of at least one - month. His primary concern with the contract is that it exceeds the authority of the Commission. Gasbarro: Motion: Schedule meeting to discuss the possible dismissal of the Manager. Gray: Seconds the Motion England: Should make counter offer of 6 -month salary without benefits. Egan: Does not feel enough time given to negotiation. Gray: Mass AG, IG, Ethics Commission, FAA and MassDOT (MAC) may be investigating. Need to remove the Manager as soon as possible.
