The existing structure is now sited about 6.7 feet from the westerly side lot line, with minimum side yard setback of 10 feet now required in the R -10 zoning district. The applicants propose to construct an addition, which will extend the westerly face of the dwelling in the same plane without coming any closer to the westerly lot line. Accordingly, the applicants request that they be granted relief by Special Permit for the alteration of the pre- existing nonconforming structure and for reduction in side yard setback from 10 to 5 feet, as authorized under §139- 16.C(1) in the R -10 district, to authorize this alteration. Lot area is about 5,064 square feet, with 10,000 square feet required in the R -10 district. The proposed alterations will comply with all other zoning requirements, including ground cover. The applicants also propose to construct a handicapped access ramp in the side yard setback in order to accommodate a handicapped family member; this ramp is exempt from dimensional zoning requirements by statute. The Applicants propose to construct an addition that will not come any closer to the westerly side lot line than what presently exists. Accordingly, the Applicants are requesting a Special Permit in order to alter the structure and to reduce the side yard setback from 10 feet to 5 feet. The locus is also nonconforming as to lot area, containing about 5,064 square feet in a zoning district in which minimum lot area is 10,000 square feet. The locus is situated at 33 AUTOPSCOT CIRCLE, is shown on Nantucket Tax Assessor's Map 55 as Parcel 512, is shown as Lot 224 on plan recorded with Nantucket Deeds in Plan File 42 -N, and the Owner's deed is recorded in Book 310, Page 355; the Applicants' Notice of Lease is recorded in Book 761, Page 255. The locus is situated in a Residential -10 zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation. Except for the presentation by the Applicants' attorney, there was no support nor opposition received in person or by correspondence at the public hearing. 4. The subdivision in which the locus is situated was situated in a Residential -1 zoning district at the time the preliminary subdivision plan was filed, and accordingly had the benefit of a zoning freeze period under provisions of the Zoning By -law and the Massachusetts Zoning Enabling Act at the time when the dwelling upon the locus was constructed. Accordingly, the dwelling conformed to the applicable side yard setback requirement of 5 feet when it was constructed, and became a pre- existing, nonconforming structure when the zoning freeze period expired. 5. As presented by the Applicant's representative, one of the individual Applicants is now physically disabled, and the purpose of the proposed alteration of the dwelling is to accommodate her disability. As part of the project to alter the dwelling, the Applicants propose to construct a handicap access ramp within the westerly side yard setback area; this ramp is exempt from dimensional zoning requirements under Massachusetts law. The Applicants propose to construct a first -story addition to the dwelling, partially within the 10 -foot setback area and continuing the side line of the existing structure and no closer than the existing structure to the side lot line, in order to provide for access and coordination of the ramp to the first story of the house. The proposed configuration is shown upon a site plan by Blackwell & Associates, Inc., dated December 6, 2011, a reduced copy of which is attached hereto as Exhibit A. The Applicants' plans have been approved by the Nantucket Historic District Commission ( "HDC ") under Certificate of Appropriateness No. 57287. 6. Based upon the foregoing presentation, the Board of Appeals made the finding that the proposed alteration would not be substantially more detrimental to the neighborhood in which the locus is situated than the pre- existing, nonconforming conditions, and that the requested relief is in harmony with the purpose and intent of the Zoning By -law.
