1. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday,
December 8, 2011, at 12:30 P.M., in the Public Safety Facility Community Room, 4
Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision
on the application of Arthur J. Wullschleger, Jr. and Carol Wullschleger, c/o Reade,
Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts
02584, File No. 079 -11:
2. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning
Bylaw Section 139 -33.A. (4) and (5) (alteration of preexisting nonconforming structure)
in order to alter the pre- existing nonconforming single family dwelling without increasing
the nonconforming nature of the structure. The Applicant proposes to alter the existing
single - family dwelling on the Locus by placing a foundation beneath an existing
residential dwelling. As a result of the proposed alteration, no changes in ground cover
or setback are proposed. The Locus is nonconforming as to the required lot area,
having a lot area of 2,863 square feet in a zoning district that requires a minimum lot
size of 5,000 square feet; is nonconforming as to the required side yard setback of five
(5) feet, being sited as close as 1.4 feet from the side yard setback; and is
nonconforming as to the ground cover ratio, having a ground cover ratio of 55.1 % in a
zoning district that has a maximum ground cover ratio of 30 %. In the alternative, the
Applicant is requesting Variance relief pursuant to Nantucket Zoning Bylaw Section
139 -32 (variances) from the intensity regulations in Section 139 -16 (setbacks, ground
cover ratio) in order to perform the work requested. The Locus is situated at 12
Center Street, Siasconset, is shown on Nantucket Tax Assessor's Map 73.1.3 as Parcel
103, and is recorded in the Nantucket County Registry of Deeds in Book 136, Page
202. The property is zoned ' Sconset Old Historic.
3. Our decision is based upon the application and accompanying materials,
and representations and testimony received at our public hearing from Applicant's
attorney and architect. The Planning Board found the matter not to be of planning
concern. Written comment was received from a few abutters, and one abutter was
present at the hearing, requesting there be certain conditions imposed on when the
work would be done.
4. Applicant informs us that a portion of the dwelling upon Locus is sinking into
the ground, and Applicant proposes to place a foundation under the dwelling in order to
rectify the problem. In the 1990's a block crawl foundation was placed under one -half
of the house facing Shell Street. The new work would require excavation under the
other half of the house facing Center Street, pouring a rat slab under the entire house,
and adding concrete block as needed to create a four foot foundation under the house,
of which less than a foot would be exposed. As a result of the work, the ridge height
would increase by less than a foot. The proposed work, which will not result in any
changes to existing ground cover or setbacks, has been approved by the Historic
District Commission.
5. The Board finds that the work is necessary and desirable in order to
preserve the existing configuration this historic structure, and is complementary and
appropriate to the scale of the adjoining streetscape. The Board also finds that the
proposed alteration of the nonconforming structure, in accordance with the HDC
approved plans, will not be substantially more detrimental to the neighborhood than the
existing nonconformities upon the lot.
6. By UNANIMOUS vote, the Board votes to grant the Special Permit relief as
requested, pursuant §139 -33 of the By -law to the extent necessary to alter a pre-
existing nonconforming structure on a nonconforming lot, to allow the proposed work.
7. The relief granted is subject to the following conditions:
a. The work shall be completed substantially in accordance with HDC
approved plans.
b. Ridge Height not to be more than one (1) foot higher than existing ridge
elevation which is equal to 49.55.
c. No exterior construction for the proposed work to be performed between
May 15t and October 1St, nor on Sundays. It is the intention of the
Board that this restriction on exterior construction be interpreted to
mean that exterior "work- stations" and exterior use of construction
power tools shall also be prohibited. Nothing herein shall prohibit usual
and customary homeowner landscaping, such as lawn mowing,
trimming of hedges, and the like.
