complaint in Land Court within TWENTY (20) days after this day's

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, November 10, 2011, at 1:00 P.M., at 4
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of CAROL BUNEVICH AND JOHN
MERSON, PO Box 445, Siasconset, MA 02564, File No. 071 -11:
2. Applicants are requesting Special Permit relief
pursuant to Nantucket Zoning Bylaw Section 139- 16.C.(1)
(setbacks - reducing ten foot setback to five feet) in order to
reduce the side yard setback from ten (10) feet to five (5) feet
in order to validate the existing air conditioning units that
are sited approximately 8.7 feet from the side yard setback. In
the alternative, the Applicants are requesting Variance relief
pursuant to Nantucket Zoning Bylaw Section 139 -32 from the
intensity regulations in Section 139 -16 (intensity regulations -
setbacks) to validate the intrusion. The Locus is situated at
71 Baxter Road, is shown on Nantucket Tax Assessor's Map 49 as
Parcel 26.1, is shown on Plan No. 17825 -A, Plan Book 4, Page 46,
is registered as Certificate of Title No. 21,251 in the
Nantucket County Registry District of the Land Court, and title
is recorded in the Nantucket County Registry of Deeds in Book
889, Page 280. The property is zoned SR -20.
3. Our decision is based upon the application and
accompanying materials, representations, and testimony received
at our public hearing. There was no Planning Board
recommendation on the basis that no matters of planning concern
were presented. One letter was received in favor of the
application.
4. John Merson represented himself at the hearing. Mr.
Merson stated to the Board that the he is requesting Special

Permit relief pursuant to Nantucket Zoning Bylaw Section 139 -
16.C.(1) (reduction of side yard setback from ten feet to five
feet) in order to reduce the side yard setback from ten (10)
feet to five (5) feet in order to validate the location of the
existing air conditioning units that are sited approximately 8.7
feet from the side yard setback in a zoning district that
requires a ten (10) foot side yard setback.
Mr. Mesron explained that his house has been recently relocated
pursuant to the Variance granted in 017 -08. In doing so, the
dwelling was lifted and moved out of the side yard setback
(being sited as close as 4.6 feet from the southerly side yard
setback) and relocated to its current position (with air
conditioning units sited as close as 8.6 feet from the southerly
side yard setback). If the Board grants the Special Permit to
reduce the side yard setback from ten feet to five feet, the
structure will be conforming as to side yard setbacks.
5. Therefore, after a discussion with the Applicant and
Counsel for the Applicant, the Board finds that such a Special
Permit may be granted to reduce the side yard setback from ten
(10) feet to five (5) feet to allow the siting of the air
conditioner units because such a permit would be in harmony with
the general purpose and intent of the Zoning Bylaw.
6. Accordingly, by a UNANIMOUS vote of the sitting Board,
the Board of Appeals made the finding that a Special Permit
reducing the side yard setback from ten (10) feet to five (5)
feet could be granted to the Applicant in order to allow the
Applicant to site a studio within said ten (10) foot setback
would be in harmony with the general purpose and intent of the
Zoning Bylaw with the condition that the structure shall be
sited as shown on the attached site plan entitled, "ZBA Exhibit
Plan," prepared by Nantucket Surveyors, Inc., dated July 6,
2011, attached hereto as "Exhibit A."
