At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, November 10, 2011, at 1:00 P.M., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of JOAN G. RUBIN, as trustee of THE JOAN G. RUBIN MASSACHUSETTS REALTY TRUST, c/o Reade, Gullicksen, Hanley, & Gifford, LLP, 6 Young's Way, Post Office Box 2669, Nantucket, MA 02584, File No. 074 -11: 2. The Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139- 33.A.(4) and (5) (alteration of preexisting nonconforming structures) in order to alter her preexisting nonconforming single- family dwelling without increasing the nonconforming nature of said structure. The proposed addition will be no closer to the side lot line than the existing 7.2 feet. In the alternative, the Applicant is requesting Variance relief pursuant to Nantucket Zoning Bylaw Section 139 -32 from the intensity regulations in Section 139 -16 (intensity regulations - setbacks) to complete the work requested. The Locus is situated at 20 Sherburne Turnpike, is shown on Nantucket Tax Assessor's Map 30 as Parcel 195, is shown as Lot 7, Plan Book 14, Page 40, and is recorded at the Nantucket County Registry of Deeds in Book 1110, Page 16. The property is zoned Residential - 1. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that no matters of planning concern were presented. There were no comments either in favor of or in opposition to the application. 4. Attorney Arthur Reade represented the Applicant. Attorney Reade explained to the Board that the Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139- 33.A.4) and (5) (alteration of preexisting nonconforming structures) in order to alter her preexisting nonconforming single- family dwelling without increasing the nonconforming nature of said structure. Attorney Reade stated that the structure is nonconforming as to side yard setback, being sited approximately 7.2 feet from the northerly side lot line in a zoning district that requires a five (5) foot side yard setback, but a ten (10) foot side yard setback when that setback is from an abutting way pursuant to Section 139- 16.C.(3) of the Bylaw. The proposed additions will be to both the easterly and westerly sides of the house, but will be no closer to the side lot line than the existing encroachment at 7.2 feet. 5. Therefore, after a discussion with the attorney for the Applicant, the Board finds that such a Special Permit may be granted to approve the alteration of the preexisting nonconforming structure as the alteration will not intrude into the setback any further than what presently exists and that this type of alteration would not be substantially more detrimental to the neighborhood than the existing nonconformity on the Locus. 6. Accordingly, by a unanimous vote of the sitting Board, the Board of Appeals made the finding that the proposed alteration to the preexisting nonconforming structure would not be substantially more detrimental to the neighborhood than the existing nonconformity and allowed the proposed alteration to the structure to be done in substantial conformity with the plan entitled "Plot Plan to Accompany a Zoning Board of Appeals Application in Nantucket, Massachusetts," prepared by Earle & Sullivan, Inc., dated August 11, 2011, attached hereto as "Exhibit A."
