I. Call to Order:
Chairman Toole called the meeting to order at 1:03 PM.
II. Approval of the Agenda:
A motion was made (Koseatac) and duly seconded to approve the agenda as written. The vote
was 5 -0 in favor.
III. Approval of the Minutes:
A motion was made (Koseatac) and duly seconded to approve the minutes of the August 11th and
August 18th ZBA hearings. The vote was 5 -0 in favor.
IV. Other Business:
• Approval of FY 2011 Annual Town Report:
A motion was made (Waine) and duly seconded to approve the Fiscal Year 2011 Annual
Town Report for the Zoning Board of Appeals. The vote was 5 -0 in favor.
■ Release of escrow:
A motion was made (O'Mara) and duly seconded to approve the request to release the
escrow funds for the Abrem's Quary project that was withdrawn. The vote was 5 -0 in
favor.

Tori Wilson represented the Applicant.
Ms. Wilson explained to the Board that the Applicant is requesting a Special Permit in
order to increase the allowable ground cover so the Applicant can construct an addition.
Mr. O'Mara noted that the Board of Appeals routinely grants requests in the Sesapana
neighborhood. The Board requested Attorney Glidden to give a recap of the history of
this particular subdivision.
A motion was made (Angelastro) and duly seconded to approve the relief requested. The
vote was 5 -0 in favor.

Attorney Brazilian explained to the Board that the Applicant is requesting Special Permit
relief in order to alter the preexisting nonconforming structure without increasing the
nonconforming nature of said structure. Attorney Brazilian further indicated to the Board
that the Applicants are under the allowable ground cover ratio allowed on the Locus.
A motion was made (Waine) and duly seconded to approve the requested relief. The vote
was 5 -0 in favor.

Sophie Metz represented the Applicant.
Ms. Metz explained to the Board that the Applicant is requesting Special Permit relief in
order to alter the preexisting nonconforming structure without increasing the
nonconforming nature of said structure. Ms. Metz explained the history of the parcel and
how it became nonconforming.
A motion was made (Angelastro) and duly seconded to approve the requested relief. The
vote was 5 -0 in favor.

Nathan McMullen represented the Applicant.
Mr. McMullen explained that the Applicant is requesting Special Permit relief in order to
alter the preexisting nonconforming structure without increasing the nonconforming
nature of said structure. Mr. McMullen further described the various nonconformities
existing on the Locus and further noted that there will be a surveyor present during the
construction process in order to ensure all setbacks are maintained.
A motion was made (Waine) and duly seconded to approve the relief requested. The vote
was 5 -0 in favor.

Attorney Marianne Hanley represented the Applicants.
Attorney Hanley explained to the Board that the Applicants are requesting a Special
Permit in order to allow for take -out.
A motion was made (Angelastro) and duly seconded to approve the relief requested. The
vote was 5 -0 in favor.

Devin Remick represented the Applicant.
Mr. Remick explained to the Board that the Applicant is requesting to validate an
unintentional setback intrusion on the Locus. This error was discovered when the
Applicant attempted to close out the existing permits.
A motion was made (Angelastro) and duly seconded to approve the relief requested. The
vote was 5 -0 in favor.

Denise Riseborough represented herself.
Ms. Riseborough explained to the Board that she would like to convert the existing
structure to a Laundromat and retail establishment. Accordingly, the Applicant is
requesting a parking waiver and a loading zone waiver.
A motion was made (Koseatac) and duly seconded to approve the relief requested. The
vote was 5 -0 in favor.

Attorney Jessie M. Glidden represented the Applicants.
Attorney Glidden explained the nature of the relief requested for both 2 and 6 Center Street,
Siasconset. Burr Tupper also provided the Board with some of the specifics regarding the
construction process.
Sheila Todd, an abutter, spoke against the application of 6 Center Street by stating that the
height of the building will be out of scale with the rest of the structures in the neighborhood.
Leslie Mayer, an abutter, also spoke against increasing the height of the structure.
Sam Daniels, an abutter, expressed concerns with the increased traffic and congestion and
possible road closures.

Don Heyda, an abutter, requested that the Board ask for a construction protocol for the
proposed work.
Mr. Tupper further detailed the work proposed for 2 and 4 Center Street.
Leslie Mayer spoke against this aspect of the application because she didn't think a historic
structure should be moved.
Sheila Todd explained to the Board that the neighbors in `Sconset do not like to see the
change to these historic structures.
Sam Daniel expanded on this by stating that he didn't want to see the buildings moved at all.
Leslie Mayer reiterated her previous comments and further added that she wants to keep the
relationship between the structures in tact and maintain the historical philosophy.
Michael Angelastro explained to the neighbors that most of these concerns are not within the
Board of Appeals' purview and that these concerns should be taken up with the Historic
District Commission.
A motion was made (Waine) and duly seconded to continue the matter to the October 13th
hearing. The vote was 5 -0 in favor.
VII. Adjournment
A motion was made (Koseatac) and duly seconded to adjourn the hearing at 3:30 pm.
