HomeMy WebLinkAbout2003-12-10BOARD OF HEALTH TOWN OF NANTUCKET MINUTES '' DECEMBER 10, 2003 - SUPERIOR COURT ROOM ~~~ MEMBERS OF THE B.O.H. PRESENT: MR. MURPHY, MR. SPRIGGS, MR. FEE, MR. SOVERINO, AND MR. WATTS MEETING CALLED TO ORDER: Approx. 7:00 p.m. 1. Chairman Murphy opens the BOH meeting for 12/10/2003 starting with any public comment for the BOH for the items that are not on tonight's agenda. 2. We will move to new business. Approval of the Minutes of August 27, 2003. Board approval of the minutes. Any discussion? MR. SPRIGGS: Yes, having said that, I know Richard is not here but would you pass on to him that on page 8, it says he was going to talk to Hilliard about getting parcels of land, a GIS map of town-owned land -from the August 27~' meeting. CHAIRMAN MURPHY: All those in favor of approving the Minutes, say aye. Board: Aye. CHAIRMAN MURPHY: All those opposed? Motion carries. 3. Item B request for variance at #6 and #8 D Street in Madaket - Mr. Crowley would you give us some background on this? ASSISTANT HEALTH INSPECTOR ARTELL CROWLEY: I am Artell Crowley, Assistant Health Inspector. This is an existing property with an existing septic system and well at 8 D Street in Madaket. The septic system failed upon inspection. They are looking for relief from the 150-foot set backs between the well and septic. They are getting about 120 feet. It is just over 100 feet. We are getting the maximum feasible compliance out of that, as well as the 50-foot side and setbacks. CHAIRMAN MURPHY: Thank you. Anyone else from the public wish to speak on this request? Any Board comments? MR. WATTS: This is an old system that failed, correct? There is no other way that, according to this map, that he can do it, correct? ASSISTANT HEALTH INSPECTOR CROWLEY: Correct. MR. SPRIGGS: I have one other question. Is there an alternative system rather than a regular Title V system that can go in there? ASSISTANT HEALTH INSPECTOR CROWLEY: There is, but I don't believe it is required by Title V. In this situation, we are getting a better situation right now. The well and septic are less than 100 feet apart currently. We are getting over 100 feet, but under 150 feet, so again it is the maximum feasible compliance for the distance between the well and septic, and we are getting the best situation for everybody. MR. SPRIGGS: Thank you, Mr. Chairman. I make a motion that we accept the Health Inspector's recommendation and grant the requested variance. Motion seconded. CHAIRMAN MURPHY: Motion made and seconded. Any further discussion? CHAIRMAN MURPHY: I have a couple of comments. I am not inclined to support the variance, and I don't think I am going to be inclined to support any variances in Madaket Watershed Overlay District or the Town Harbor Overlay District. I think we are going to have to go to alternative systems. The reasons we went to 150-foot separation between sewage and well water is well documented in Madaket, and it doesn't take much of an 2 imagination to figure out why that is. This is the maximum feasible compliance for this property, it isn't the maximum legal compliance nor is it under BOH regulations, the maximum advisable compliance, so one of the goals for this Board from last year and for next year is to improve and protect our aquifer and harbor water quality and granting these kinds of easements works completely against that, in my opinion.
