Addition to existing house
ADDENDUM
We are asking to add an addition to a pre existing, non conforming structure on the
property. The house was constructed in 1981 and a building permit was issued on
10/14/81 #2054 -81. The zoning at the time of construction was R -1. The non conforming
portion of the dwelling is the front yard setback to the south of the structure as it
presently sits on lot. It is 27.5' instead of 30' required with the present SR -20 zoning
requirements.
In February of 2011, the HDC approved an addition on the west side of structure and a
porch roof over existing deck. (COA# 56023.) A building permit was issued for this
work to be constructed in March 2011 without incident as the proposed work met the
criteria for the zoning requirements with regard to setbacks, ground cover, etc. ( building
permit # 291 -11.)
This past July 2011, another additive mass was approved by the HDC to the easterly
portion of the existing structure (COA# 56729) and an amendment was filed to existing
open (building permit # 291 -11). The Zoning Officer called to inform us at this time that
he could not longer issue a permit for this work and told us that we needed to apply for a
Special Permit. He said that the dwelling was a pre existing, non conforming structure
and that any work to alter it had to have a Special Permit from the Zoning Board of
Appeals. He could no longer issue such permits within the scope of his office as revised
by Town Meeting this past April. '
We are asking to add two additive masses that meet both the setback requirements and
meet the ground cover ratio without need of relief from the ZBA. One addition is
presently under construction with (building permit #291 -11 ) and the other addition will
commence once an amendment to this open permit is issued for a Special Permit to do so.

1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, October 13, 2011, at 1:00 P.M., at 4
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of ASHLEY GEBHARDT, PO Box
7063, Siasconset, MA 02564, File No. 060 -11:
2. Applicant is requesting Special Permit relief pursuant to
Nantucket Zoning Bylaw Section 139 -33.A. (4) and (5) (alteration
of preexisting nonconforming structure) in order to alter the
pre- existing nonconforming single family dwelling without
increasing the nonconforming nature of the structure. The
structure is nonconforming as to front yard setback, being sited
as close as 27.5 feet from the front yard setback in a zoning
district that requires a thirty (30) foot front yard setback.
The Locus and structures thereon are otherwise conforming to the
intensity regulations of the `Sconset Residential - 20 zoning
district. In the alternative, the Applicant is requesting
Variance relief pursuant to Nantucket Zoning Bylaw Section 139 -32
(variances) from the intensity regulations in Section 139 -16
(intensity regulations - setbacks) in order to complete the work
requested. The Locus is situated at 15 Clifton Street, is shown
on Nantucket Tax Assessor's Map 73.4.1 as Parcel 73, and is
recorded in the Nantucket County Registry of Deeds in Book 836,
Page 190. The property is zoned `Sconset Residential - 20.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. There were no comments either in favor of or in
opposition to the application.
4. Valorie Oliver represented the Applicant. Ms. Oliver
explained to the Board that he Applicant is requesting Special
Permit relief pursuant to Nantucket Zoning Bylaw Section 139 -
33.A.(4) and (5) in order to alter the pre- existing nonconforming
structure on the Locus without increasing the nonconforming
nature of said structure.
Ms Oliver further stated that the structure is nonconforming as
to front yard setback, being sited as close as 27.5 feet from the
front yard setback in a zoning district that requires a thirty
(30) foot front yard setback. The proposed addition it to the
rear of the structure and will be entirely outside the side and
rear yard setbacks.
5. Therefore, after a discussion with the agent for the
Applicant, the Board finds that such a Special Permit may be
granted to approve the alteration of the preexisting
nonconforming structure as the alteration will not intrude into
the setback any further than what presently exists and that this
type of alteration would not be substantially more detrimental to
the neighborhood than the existing nonconformity on the Locus.
6. Accordingly, by a unanimous vote of the sitting Board,
the Board of Appeals made the finding that the proposed
alteration to the preexisting nonconforming structure would not
be substantially more detrimental to the neighborhood than the
existing nonconformity and allowed the proposed alteration to the
structure to be done in substantial conformity with the plan
entitled "Ashley Gebhardt, 15 Clifton Street, Proposed Additions
to Existing Dwelling, " prepared by Nantucket Surveyors, Inc., as
modified by Valorie Oliver, and referenced by the Nantucket
Zoning Board of Appeals, dated October 13, 2011, attached hereto
as "Exhibit A."
