NANTUCKET ZONING BOARD OF 2 Fairgrounds Road Nantucket, Massachusetts Assessor's Map 55.4.4 Parcel 34 14 Mt. Vernon Street Residential - 1 DECISION: APPEALS 02554 Book 516, Page 58 1. At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, October 13, 2011, at 1:00 P.M., at 4 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of PEACEFUL NEIGHBORS, LLC, c/o Christina M. Cowles, 111 Oscaleta Road, South Salem, NY, 10590, File No. 062 -11: 2. Applicants are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139- 16.C.(2) (unintentional setback intrusions) in order to validate the existing setback intrusion in the rear yard setback from construction that was completed in 2005. The structure is sited as close as 4.21 feet from the rear yard setback in a zoning district that requires a five (5) foot rear yard setback. The Locus and structures thereon are otherwise conforming to the intensity regulations of the Residential - 1 zoning district. In the alternative, the Applicant is requesting Variance relief pursuant to Nantucket Zoning Bylaw Section 139 -32 (Variances) from the intensity regulations in Section 139 -16 (intensity regulations - setbacks) to validate the existing setback intrusion. The Locus is situated at 14 Mount Vernon Street, is shown on Nantucket Tax Assessor's Map 55.4.4 as Parcel 34, and is recorded at the Nantucket County Registry of Deeds in Book 516, Page 58. Strain. application and and testimony o Planning Board planning concern from an abutter, 4. Frederick Cowles represented the Applicants. Mr. Cowles explained to the Board that the Applicants are requesting Special Permit relief pursuant to Nantucket Zoning Bylaw Section 139- 16.C.(2) in order to validate the existing setback in the rear yard setback from construction that was completed in 2005. Mr. Cowles stated that the structure is sited as close as 4.21 feet from the rear yard setback in a zoning district that require a five (5) foot rear yard setback. Said intrusion occurred when a trash shed was moved in 2005 as part of a renovation project. The intrusion was ultimately called to the Applicants' attention in July 2011 as part of a request for a Certificate of Occupancy. 5. Therefore, after a discussion with the agent for the Applicants, the Board finds that such a Special Permit may be granted to approve unintentional setback intrusion of 0.79 feet into the required five (5) foot side yard setback on the basis that the burden of correcting the intrusion substantially outweighs any benefit to any abutter of eliminating said intrusion. The Board came to this finding because of the abutter support and because the intrusion is de minimis (i.e., less than ten inches). 6. Accordingly, by a unanimous vote of the sitting Board, the Board of Appeals made the finding that the burden of correcting the unintentional setback intrusion substantially outweighs any benefit to any abutter of eliminating said intrusion and therefore allowed the intrusion to exist as shown on the plan entitled "Plot Plan of Land in Nantucket, MA," prepared by John J. Shugrue, Inc., dated July 20, 2006, attached hereto as "Exhibit A."
